City Council <br />Meeting Minutes <br />August 5, 2008 <br />Page 5 of 14 <br />1) Section 17.20.165 A.6 was modified to eliminate a required 5' setback <br />adjacent to a side lot line. <br />2) Section 17.20.165 A.5 was modified to add a minimum setback of 18" <br />from an existing sidewalk. Section 5 would require an 18" setback from an <br />existing sidewalk, no encroachment into a public right-of-way, and no <br />encroachment into a vision clearance area. <br />Council directed Staff to evaluate the feasibility of adding a process by which a <br />property owner would be able to request zoning relief from the requirements of <br />the ordinance and suggested the Board of Adjustment might provide the <br />appropriate venue to have jurisdiction over such requests. Variances: If Council <br />adopts the ordinance with only five regulating criteria, it will not be necessary to <br />have a mechanism for granting variances. The following second reading <br />amendments have been added to the ordinance: <br />1) Section 17.20.160 Motor Vehicles: Subsection C was deleted to eliminate <br />the requirement to screen motor vehicles parked or stored in a side yard <br />adjacent to a street. <br />2) Section 17.20.165 Recreation Vehicles and Trailers: Subsection 4 was <br />deleted to eliminate the requirement that recreational vehicles and trailers <br />parked in a side yard adjacent to a street in screened by a solid screening <br />fence. <br />3) Subsection 6 was deleted to eliminate the rear yard setback requirement. <br />4) Subsection 7 was deleted to eliminate the requirement that a recreational <br />vehicle or trailer can only be located on a property if the owner of the <br />vehicle or trailer resides on the property. <br />PUBLIC COMMENT <br />Howard Pollock, 834 Lincoln Avenue, Louisville, CO thanked Planning Director <br />Wood and Police Chief Bruce Goodman for their work on the ordinance. He <br />suggested the City look at the boats, vans, and pick-up trucks, which are also <br />parked on City streets. He voiced his opposition to an ordinance, which <br />compares trash dumpsters with recreational vehicles. <br />Jerry Davis, 703 Lois Drive, Louisville, CO did not support the restriction of <br />parking of RV's and trailers and asked how many complaints have been received <br />over the past five years. Police Chief reported within the last year there were <br />approximately three or four complaints. <br />Ian Karpel, 928 LaFarge Avenue, Louisville, CO supported the ordinance and felt <br />it balances the rights of RV owners and the neighborhood. He urged Council to <br />pass the ordinance. He addressed the number of complaints filed and noted <br />without an ordinance there is not a process to file a complaint. <br />
