4/1'7/84 Page -13- <br />the:re was no liquor in site. The bartender <br />did admit that he had been serving some <br />people in the establishment. However that <br />admission could not be used in prosecution. <br />Councilwoman Morris expressed concern about <br />how Council and police officers can enforce <br />laws that are basic to liquor license renewals, <br />and make it known emphatically to the owners <br />these incidents will not be tolerated. <br />Attorney Rautenstraus advised that similiar <br />action could be taken as with a previous <br />renewal, i.e. public hearing and reprimand. <br />He suggested one action council should not <br />take this evening would be to deny the appli- <br />cation. If council should consider that, a <br />public hearing should be held with the oppor- <br />tunity for the applicant to present their <br />case. Should council approve the application, <br />they do have the right at any time to call <br />it up for revocation hearing and at that <br />time take evidence and testimony and determine <br />whether the liquor license should be revoked <br />at that time. <br />Motion for a Public Hearing Councilwoman Morris moved that a public <br />hearing be held on the renewal of the <br />Track Inn liquor license so that Council <br />can. discuss their concerns with the owner <br />of the establishment and support our Police <br />Officers in their efforts in enforcing the <br />ordlinance that the City has. <br />Councilman Woodson Conunented that he concurred with Council- <br />woman Morris' concerns; but from what Chief <br />Leesman had said there is nothing substantial <br />now for prosecution of a case that the City <br />Attorney could pursue . <br />Councilwoman Morris responded that she was <br />not: so much interested in the prosecution <br />aspect but more in communications so that <br />kind of action can be prevented. <br />Mayor Meier Suggested that council renew the liquor <br />license and that they be sent a written <br />reprimand that if the same type of infractions <br />as reported again occur prior to their.' liquor license <br />renewal date, their license will be subject <br />to revocation. <br />
