2/7/84 Page -8- <br />Th.e recreation. area was just north of the <br />mall site - Davidson Mesa to the west, and <br />th.e property that runs along Hiway 36 on <br />th.e south, which is the 1500' setback area. <br />Residential 'use comprised the balance of <br />th.e property. McCaslin Blvd. runs north <br />anal south. <br />Th.e next slide of the master plan showed <br />th.e land use which was reviewed in the <br />spring of 1983, and it was at this time that <br />th.e Planned Community Zone ordinance was im- <br />plemented. The new plan shows the same <br />number of acres and the emphasis has been <br />shifted from a major regional mall site to <br />a research/office theme. Residential zoning <br />went from 253 acres to 156 acres in the new <br />plan; open space in the old plan was 446 acres, <br />in the new plan it is 444 acres. An enclave <br />which was shown in white was not under the <br />ownership of Homart. In the old plan Mc <br />Ca.slin Blvd. was on the west side, in the <br />ne:w plan it is on the east side of the en- <br />clave property then continues on to the <br />Superior Interchange. The Planning Dept. <br />ha.d prepared a wall map depicting the old <br />zoning with an overlay of the new zoning, <br />and Director Rupp explained the changes. <br />AGREEMENT - PLANNED COMMUNITY Attorney Rautenstraus advised that under <br />ZONE the Planned Community Zane District there <br />is'. a requirement for a development agree- <br />ment to be entered into between the City <br />and the developer. This did occur and was <br />adopted on December 6, 1983. Councilmembers <br />ha,d been supplied an outline of the major <br />points in the agreement. Attorney Rauten- <br />straus then read and explained them. Major <br />pc>ints were General Conditions, Public Use <br />Dedication, Water Utility Improvements, <br />Waste Water Improvements, Street Improvements, <br />Other Public Improvements, i.e. drainage, <br />trees, recreation center, Parcel B Development, <br />Remedies and Rights Under the Agreement, <br />Building Permit Phasing, and Other Standard <br />PY~ovisions. Under the Building Permit Phas- <br />ing category Attorney Rautenstraus stated <br />this sets up limitations on the building <br />permits which the subdivider would be <br />a]_lowed - 1984 - none, 1985 - 100 units, <br />
