<br />12/4/84 <br />Page -17- <br />In reply to Mayor Meier's inquiry as to when <br />Council would be looking at the change order <br />for the delineators - Mr. Cellars replied early <br />March and their estimate is $12,000. <br />Acting City Administrator Rupp commented tha•`. <br />he h,ad never seen the delinators; but he felt <br />it was important that the design of those ,:ire <br />such that they don't pose to be a traffic <br />haz a:rd . <br />:ouncilman Luce Commented that he shared Councilman Cussen's <br />concerns and frustrations - the City has <br />a contract to try to get a job done expedit_^~us1 <br />and Centennial Engineering is providing co- <br />sult:ing services to the City. We have a c~:_ <br />tractor that is attempting to deliver a prc.::_~..~t <br />and ;somewhere in the process we seem to have <br />lost our objective. <br />Mr. Cellars stated there are only so many <br />things that his company can do. The contracc..;r <br />has just as much protection from his contract <br />that the City approved as the City has. It <br />was Mr. Cellars understanding that he had until <br />Decernber 17th to finish that section. He <br />may jEinish it by this date. If he doesn't <br />there: is a punitive clause in the contract <br />and we do have the option of holding the re- <br />tainage until after all the satisfactory <br />work is done. <br />Mr. Cellars advised that they have a traffic <br />control system that if necessary that it be <br />in addition to the delineators to be in posi- <br />tion to handle the traffic until construction <br />is resumed next year. This would be pointing <br />4 lanes ahead or median ahead, pavement <br />narrows, etc. That is the contractor's re- <br />snonsibility <br />Councilman Luce stated that he would like to <br />convey to Mr. Cellars whatever leverage he <br />might have either outside the contract or wizah <br />the contract to put some pressure on gettinr; <br />that done .be used. • <br />Councilman Luce concurred with Councilman <br />Cusse:n and directred his comment to Attorney <br />Raute~nstraus stating that Council should <br />take a Look at the model that the City uses <br />for :>ome of these contracts; what sort of <br />position that leaves the City in. <br />
