10/16/84 Page -15- ADOPTION WITH AMENDMENT Vote On the Amendment VOTE ON ORDINANCE NO. 838 WITH FIRST AMENDMENT Councilman Leary then referred to M. Re- striced Rural Residential and asked if the wording eliminated clustered housing. Attorney Rautenstraus replied he did not feel it eliminated clustered housing; also did not think this zoning category is one that possibly won't be used that often. The lots are larger than most; but are not agricultural. Mayor Meier closed the public hearing. Mayor Meier moved, Councilman Luce seconded that Ordinance No. 8:38 - Office Zone be adopted with the amendment to Item L. including any commercial activity in this zone; also included in that any commercial activity in the bottom of paragraph L. Parlimentarian Rautenstraus advised that an amendment to the motion took precedent over the motion to adopt the ordinance; therefore Council .would be voting on the last sentence in paragraph L. changing it to read to any allowed commercial activities, and the next time Council would vote on the entire ordinance with the other change would would add possibly, Mayor Meier moved, Councilman Luce seconded that the ordinance be amended in paragraph L. to read to any allowed commercial activities. All in favor. Motion carried unanimously. Roll call vote: Fauson Morris Johnson Leary Cussen Luce Meier Motion carried Yes Yes Yes Yes Yes Yes Yes unanimously. ORDINANCE NO. 843 - WATER Counc.ilmembers had a copy of the Ordinance; TAP FEE INCREASE - PUBLIC Attorney Rautenstraus read it by title only HEARING on second reading and public hearing and cer- tified proper publication. Mayor. Meier opened the public hearing and Attorney Rautenstraus certified proper publi- cation of the public hearing notices. Staff presentation - None.
