9/18/84 Page -7- <br />This matter is currently in the hands of <br />the City's insurance company. <br />Wally Grant, Attorney Mr. Grant stated that the drainage problem <br />Representing the Beauprez has been a real irritant for the Beauprez's <br />and Piszek property owners for sometime and a lot of routes have been <br /> tried to resolve it. He stated that the <br /> property was located on the northeast edge <br /> of town and the Grace Mar subdivision is <br /> on the west side of the RR tracks - water <br /> drains down along the RR tracks. The major <br /> problem results from drainage being picked <br /> up through the subdivision, comes across <br /> the RR tracks, then goes into the Piszek <br /> property before it crosses the highway. <br /> Mr. Grant stated that a lot of water is <br /> being diverted by the City of Louisville <br /> under the RR tracks and just left there. <br /> Until they contacted the staff last summer <br /> and again this spring there was no effort <br /> to clean the ditches, etc. It was pumped <br /> to the edge of the tracks and left go. <br /> Consequently all that grows in that area is <br /> cat tails because it is so swampy. This <br /> has caused a great deal of seepage on to <br /> the Piszek property, which is farmed by the <br /> Beauprezs, resulted in lost crops. Some <br /> of the ground has turned alkaline so crops <br /> won't grow at all. The Beauprezs have been <br /> long time farmers in the area and have never <br /> had this problem before. Now it is worsen- <br /> ing to the point where they can't drive <br /> their farm equipment through the field. <br /> Aerial sprayers had to be brought in to <br /> spray the bugs and weeds because of the <br /> seepage condition. They estimated that in <br /> the 1983 crop year it cost them between <br /> $5,000 - $6,000. This was the amount turned <br /> over to the insurance adjuster. The Beau- <br /> prezs estimate the damage incurred this year <br /> was approximately the same. <br /> Mr. Grant stated that he had spoken, last <br /> year and on numerous occasions this year, <br /> with Leon Wurl and as recently as March of <br /> this year was told, and he told his clients <br /> that the City was in the process of having <br /> engineering plans prepared and that they <br /> would be done in a week or two and that the <br /> matter would be addressed. He was also given <br /> the information that the city staff would be <br /> out to clean the ditch. <br />
