9/4/84 Page -10- <br />She was aware that we have the back-up <br />systems that we could go to in a crisis. <br />But she felt uncomfortable putting ourselves <br />in that position. Also we are in a finan- <br />cial crunch at this time - suggested that <br />Council review this in relation to funding, <br />and permits and see where that all fits in. <br />Councilman Leary Stated the point is if we use up the 660 <br />we have the money and the expansion could <br />be constructed on schedule. The one thing <br />that would cause a problem would be an <br />unexpected rush on commmercial. This <br />problem will not occur with the residential <br />as it is phased. He felt that we were far <br />enough ahead that we could stay ahead but <br />it was real questionable whether we would <br />meet the construction schedule as presented <br />by Mr. Schuler. <br />Mr. Schuler stated he thought it was advisable <br />to start the preliminary design and permitting <br />process. This should be completed no later <br />than March 31, 1985. The only expenditures <br />that will be made to that point is the en- <br />gineering work.and Council would have some <br />flexibility if they wished to curtail con- <br />struction. It would take 6 months to ob- <br />tain the permit and felt it could be re- <br />submitted if not used in 1985. <br />David Stahl, Representing Mr. Stahl stated that he would like to re- <br />Homart Development Co. spectfully remind the Council of an agree- <br />314 South 80th Ave. ment that was signed in Februrary, 1983. <br />Mr. Schuler has stated that we are currently <br />pushing at 1.20 MGD capacity on the existing <br />system although the lagoon system could be <br />activated to provide an additional 400,000 <br />to 600,000 gallons per day treatment capa- <br />city. In 1983 when they entered into the <br />agreement with the City to provide approxi- <br />mately $980,000 for .34 expansion to the <br />sewer treatment plant, the City agreed to <br />reserve that .34 capacity exclusively for <br />Homart Development Co. This is in paragragh <br />6 B. of the agreement. Mr. Stahl then read <br />this paragraph verbatim to the Council and <br />stated that it was certainly their interpre- <br />tation that the City is encroaching at this <br />point on their .34 capacity. The City is <br />permitted for 1.34 MGD and the difference <br />between .34 and 1.34 would allow the City <br />1 MDG for treatment capacity. <br />
