9/4/84 Page -10-
She was aware that we have the back-up
systems that we could go to in a crisis.
But she felt uncomfortable putting ourselves
in that position. Also we are in a finan-
cial crunch at this time - suggested that
Council review this in relation to funding,
and permits and see where that all fits in.
Councilman Leary Stated the point is if we use up the 660
we have the money and the expansion could
be constructed on schedule. The one thing
that would cause a problem would be an
unexpected rush on commmercial. This
problem will not occur with the residential
as it is phased. He felt that we were far
enough ahead that we could stay ahead but
it was real questionable whether we would
meet the construction schedule as presented
by Mr. Schuler.
Mr. Schuler stated he thought it was advisable
to start the preliminary design and permitting
process. This should be completed no later
than March 31, 1985. The only expenditures
that will be made to that point is the en-
gineering work.and Council would have some
flexibility if they wished to curtail con-
struction. It would take 6 months to ob-
tain the permit and felt it could be re-
submitted if not used in 1985.
David Stahl, Representing Mr. Stahl stated that he would like to re-
Homart Development Co. spectfully remind the Council of an agree-
314 South 80th Ave. ment that was signed in Februrary, 1983.
Mr. Schuler has stated that we are currently
pushing at 1.20 MGD capacity on the existing
system although the lagoon system could be
activated to provide an additional 400,000
to 600,000 gallons per day treatment capa-
city. In 1983 when they entered into the
agreement with the City to provide approxi-
mately $980,000 for .34 expansion to the
sewer treatment plant, the City agreed to
reserve that .34 capacity exclusively for
Homart Development Co. This is in paragragh
6 B. of the agreement. Mr. Stahl then read
this paragraph verbatim to the Council and
stated that it was certainly their interpre-
tation that the City is encroaching at this
point on their .34 capacity. The City is
permitted for 1.34 MGD and the difference
between .34 and 1.34 would allow the City
1 MDG for treatment capacity.
