8/21/84 Page -13- be passed with the 60% figure as suggested by Mr, Krueger and more research be done to see if this should then be increased to 80%, In reply to Councilman Leary's inquiry, Attorney Rautenstraus advised that it was his understanding that in almost every case the 80% figure would cover the land- scaping tap also. But in certain circum- stances based on the type of multi-family development, the number of units, etc, it might be appropriate for some type of tap fee also for the landscaping. The sug- gestion was made that the City would amend sub-division agreements that were existing and then with any sub-division agreement if there was going to be a tap fee charged for the landscaping that would be covered in the sub-division agreement as they come in. Because that would be the time to review what the landscaping was, etc. Councilman Leary stated that a 3/4" tap is being used 365 days a year for residential use; while a 2" landscaping tap would have less usage throughout the year. Commented cost wise the City should be doing fairly well in this respect because of the cost of the 2" tap. Mayor Meier closed the public hearing. ORDINANCE NO. 832 ADOPTED Councilman Cussen moved, Councilman Leary WITH CHANGES seconded that Ordinance No. 832 - Multi- Family Water and Sewer Tap Increase be adopted and the percentage figure in Section 3. C. 2. be changed to 60% in place of 80%, also Section 5. 2. be changed to 60% in place of 80°s. Roll call vote: Fauson Yes Meier Yes Johnson Yes Cussen Yes Leary Yes Motion carried unanimously. ORDINANCE NO. 839 - PLISKA Councilmembers had a copy of the ordinance, ANNEXATION - PUBLIC HEARING Planning Commission recommendation, letter from the applicant, excerpt of the Planning Commission minutes and letter from a neigh- bor requesting that Council consider a restriction of 25' on the heighth of Mr. Pli.ska's residence.
