8/21/84
Page -14-
Attorney Rautenstraus read the ordinance
by title only on second reading and public
hearing and certified proper publication.
Mayor Meier opened the public hearing and
Attorney Rautenstraus certified proper pub-
lication of the public hearing notices.
Staff Presentation Acting City Administrator Rupp gave a slide
presentation of the site stating that it
was located on the west side of Continental
View Drive and north of South Boulder Road,
County residential zoning and consisted of
1.2 acres. Mr. Rupp advised that the pro-
posal involved a two-step annexation as
the State Statutes require a contiguity re-
quirement and in order to meet that, the
annexation has to be done in two phases.
Residential-rural zoning allows one dwelling
unit per 20,000 sq.ft. The applicant is
only requesting a single home site. It is
on the peripheral of our urban services area.
The application is consistent with the
Council's adopted annexation policy and the
recommendation from the staff .is that the
aannexation is in conformance with the City's
comprehensive plan and meets with Council's
Resolution on annexation. The recommended
zoning to R-R is consistent with the character
of the surrounding area and is suitable as
an appropriate transition to the City's open
space. The Planning Commission unanimously
recommended approval. Also, they did not
make a recommendation on the request of the
neighbor who wished that Mr. Pliska's resi-
dence be the same as the covenants that
restricted the heighth of thier residence.
Planning Commission felt that the annexation
and zoning was consistent with Louisville's
development policies. There was no stipu-
lation from the part of the staff to restrict
the building height to 25'.
Mayor Meier continued the public hearing
and asked if the applicant wished to make
a presentation. Mr. Pliska stated that
he had nothing to add.
Public comments in favor or against Ordinance
No. 839. - None.
