Louisville City Council Meeting
May 18, 2004

as the Pickett Annexation is currently an un-incorporated Boulder County parcel and is
zoned Boulder County Suburban Residential. The Applicant proposes a rezoning to the
City of Louisville zoning classification of Single-Family Low-Density (SF-LD). The
rezoning was reviewed and approved by the Planning Commission. The property under
review is a large rectangular shaped parcel and is located directly north of West Spruce
Street with approximately 330 feet of frontage on West Spruce Street. Two single-family
residences (309 and 201 W. Spruce Street) are found along the street frontage. To the rear
of the Pickett properties are the City owned parcels planned for future park purposes.

Wood addressed Ordinance No. 1446, Series 2004, which annexes the 4.98-acre parcel.
The annexation map reflects that 50% of the boundary of the annexation parcel is
contiguous to the City of Louisville. With the recent annexation of the Savage property
to the west, the contiguity increases to 83%. Ordinance 1447, Series 2004 zones the
4.98-acre parcel to City of Louisville Single-Family Low Density (SF-LD).

Wood reviewed the Pickett Property Annexation Agreement, which is required prior to
final action by City Council on the Pickett Annexation. The Agreement has been
reviewed by the City Attorney and is acceptable to the owners. The two Annexation
Agreements being executed are for Pickett Parcel C - Dorothy B. Pickett Revocable
Trust and Annexation Agreement for Pickett Parcel B - Marjorie Nell and Earl D.
Pickett. Wood reviewed the annexation agreements.

Mayor Sisk opened the public heating and asked if anyone in the audience wished to
speak for or against Resolution 29, Series 2004, Ordinance Nos. 1446 and 1447, Series
2004, and the Pickett Annexation Agreement.

Teri Kristovich, 310 W. Spruce Street, Louisville, CO, stated she is the developer of the
Treehaven Subdivision. She reported meeting with the Planning Staff relative to her
reimbursement for improvements made to Spruce Street. She stated she was pleased with
the outcome of the meetings and looks forward to her reimbursement.

Mayor Sisk asked if the Applicant wished to speak.

The Applicant, Don Pickett, stated everything is proceeding according to plan.

City Manager Simmons reported the closing on the Savage property is Friday, May 21.

RESOLUTION NO. 29, SERIES 2004 - A RESOLUTION CONCERNING A
PETITION FOR THE ANNEXATION OF PROPERTY TO THE CITY OF
LOUISVILLE, COLORADO, KNOWN AS THE PICKETT ANNEXATION, AND
FINDING THE AREA PROPOSED TO BE ANNEXED ELIGIBLE FOR
ANNEXATION

MOTION: Council member Brown moved to approve Resolution No. 29, Series 2004,
seconded by Council member Levihn. All in favor.
