Louisville City Council Meeting
June 15, 2004

Council member Brown reviewed the history of The Springs at Coal Creek irrigation
water billing, and stated the credit is warranted.

MOTION: Council member Brown moved for approval of Resolution No. 30, Series
2004, as revised, seconded by Council member Levihn. All in favor.

RESOLUTION NO. 32, SERIES 2004 - A RESOLUTION APPROVING A
TELECOMMUNICATIONS SITE LEASE WITH OPTION AGREEMENT
BETWEEN THE CITY OF LOUISVILLE AND VOICESTREAM PCS II
CORPORATION

Mayor Sisk requested a Staff presentation.

Recreation & Senior Services Director Keith Williams reported on discussions with T-
Mobile Corporation relative to the possibility of placing a communication antenna on the
roof of the recreation/senior center. The Planning Department also participated in the
discussion regarding the zoning and other related items the City may require for this type
of project. The antenna would be screened according to city requirements. In exchange
for this agreement with the City, T-Mobile would pay a monthly fee of $1,354.00
beginning the third year of the lease, for five years with a ten percent (10%) increase for
each subsequent five-year period for a total of twenty-eight years. In addition, T-Mobile
will bequeath a financial gift of $100,000 to the City with $50,000 paid upon signing of
an agreement and the additional $50,000 on the one-year anniversary of the lease signing.
The total payment to the City from T-Mobile over the term of the contract will be
$694,320.16.

Williams stated the agreement provides that part of the $50,000 gift be targeted toward
the Inline Rink and incorporate a scoreboard installed with T-Mobile's name on it.
Typically a scoreboard runs from $2,500 to $8,000, depending upon specifications. If
Council approves, it is proposed that these funds be used for additional budgeted items
such as annual replacement of equipment/furniture/fixtures at the recreation/senior center
and/or improvements to the Recreation/Senior Center, as the City deems appropriate.

PUBLIC COMMENT

David Goossen, 129 Skyview Court, Louisville, CO, voiced his opposition to the
scoreboard at the Inline Rink displaying T-Mobile's name. He stated the proposal
provides a slippery slope, where one sign will lead to another sign, to the detriment of the
community.

COUNCIL COMMENT

Council member Van Pelt asked Recreation & Senior Services Director Williams if the
agreement requires the purchase of a scoreboard. Williams responded no.
