Louisville City Council Meeting <br />June 15, 2004 <br />Page 8 of 10 <br /> <br />Mayor Sisk stressed that annexations to the City of Louisville are taken on a case-by-case <br />basis. He assured Mr. Hoyle the City will comply with the Court order. He asked Mr. <br />Hoyle if it was his desire to have an Industrial zoning. Mr. Hoyle and Mr. Lopez <br />confirmed their desire to have the property zoned Industrial and Commercial. <br /> <br />Mayor Sisk reported the public hearing would be conducted on July 20th due to a public <br />notice requirement. He asked City Attorney Light to address that issue. City Attorney <br />Light reviewed the requirement of the state statute with respect to the annexation of an <br />enclave requires notice once a week for four weeks; therefore, the hearing could not be <br />conducted until July 20, 2004. <br /> <br />Mayor Sisk assured Mr. Hoyle and Mr. Lopez the zoning would be designated within the <br />90-day period. <br /> <br />Council member Brown reviewed the City's recent history with the Hoyle property and <br />explained its involvement with the Northwest Parkway Intergovernmental Agreement put <br />sanctions on the development of the property. He stated that, had the City annexed the <br />property, it would have been in violation of an Intergovernmental Agreement. He stressed <br />the City has not delayed the process, but been encumbered with the restrictions of an <br />IGA, and he voiced his resentment with statements that stated otherwise. <br /> <br />Mr. Hoyle explained his family had worked with the IGA participants to obtain their <br />agreement to the annexation of the property. <br /> <br />City Manager Bill Simmons asked City Attorney Light for the timeline with respect to <br />the Hoyle annexation and zoning. Light reviewed the State Statute pertaining to the <br />annexation of an enclave. He also reviewed the ruling and order of District Court Judge <br />Glowinsky with respect to the Virginia & Ira Hoyle Trust lawsuit. <br /> <br />MOTION: Mayor Sisk moved to publish Ordinance No. 1452, Series 2004 and public <br />hearing be set for July 20, 2004, seconded by Council member Keany. All in favor. <br /> <br />CITY ATTORNEY'S REPORT <br /> <br />City Attorney Light requested Council direction on a zoning ordinance for the Hoyle <br />property, and for authorization to work with Staff on the zoning for the property. Council <br />authorized the City Attorney to proceed. <br /> <br />CITY MANAGER'S REPORT <br /> <br />Land Management Director Cindy Lair updated Council on the City's two new trails, the <br />Davidson Mesa Trail and the Callahan Trail, and an open house to re-introduce the <br />projects to the community. The open house will be held on Monday, June 21st. She <br />distributed written materials and an aerial map showing the new trails. <br /> <br /> <br />
