He thanked the Mayor and Council for the recognizing his service. <br /> <br />ORDINANCE NO. 1455, SERIES 2004 - AN ORDINANCE APPROVING THE <br />REZONING OF THREE ADJACENT BUT SEPARATELY OWNED PARCELS <br />AT THE NORTHEAST CORNER OF DILLON ROAD AND SOUTH 96TM <br />STREET FROM AGRICULTURE (A) TO PLANNED COMMUNITY ZONED <br />DISTRICT (PCZD-C) 2nd reading - public hearing - (advertised Daily Camera <br />September 11, 2004) <br /> <br />Mayor Sisk requested a City Attorney introduction. <br /> <br />City Attorney Sam Light read Ordinance No. 1455, Series 2004. <br /> <br />Mayor Sisk reopened the public hearing and requested a Staff Presentation. <br /> <br />Planning Director Paul Wood Staff Presentation: <br /> <br />The applicants, the St. Louis Catholic Parish (represented by Rev. G. Timothy Gaines), <br />Adrian Games, and Richard and Mary Johnson are jointly requesting approval of the St. <br />Louis Parish and Louisville Commercial Park General Development Plan (GDP). The <br />request includes rezoning the subject parcel from City of Louisville Agriculture to <br />Planned Community Zone District - Commercial (PCZD-C). The total annexation <br />acreage is 53.95. <br /> <br />The revised General Development Plan reflects three zones of development. The GDP <br />specifies design and building bulk standards for each sub-zone. The organization of these <br />planning areas has been organized along 'zones of intensity or transition' rather than <br />strictly along parcel ownership boundaries. Planning area zones are organized in 'layers', <br />which are parallel to S. 96th Street. Areas of greater intensity are to the east. Zone I is <br />approximately 16.2 acres and is designated for the church and school campus. Zone II is <br />approximately 31.8 acres and Zone III is approximately 3.4 acres and have an overall <br />FAR of 0.20, or a build out of approximately 306,531 SF, of which 70,000 SF would <br />primarily be retail, office and other commercial uses. Zone 2A, which is adjacent and <br />parallel to S. 96th Street has a more restrictive maximum FAR of 0.17. <br /> <br />The purpose of the PCZD Zoning Agreement would specify Owner responsibility for <br />assuming full obligations as a Subdivider in securing a guarantee for and the installation <br />of required public improvements, as well as meeting the full public use dedication <br />requirement. <br /> <br />The Planning Commission reviewed this proposal three times: April, June and July of <br />2004. The concerns of the Commissioners related to the timing of the request relative to <br />the update of the Citywide Comprehensive Plan, the predominantly commercial nature of <br />the rezoning request, and the issue of traffic. The Commission's five conditions have <br />been met and incorporated into the PCZD Agreement. <br /> <br />3 <br /> <br /> <br />
