Louisville City Council Meeting <br />December 21, 2004 <br />Page 4 of 8 <br /> <br />Mayor Sisk requested a Staff presentation. <br /> <br />Public Works Director Tom Phare explained that under the directive and requirement of <br />the Environmental Protection Agency (EPA) Phase II Stormwater Regulations, Federal <br />Water Pollution Control Act and the Colorado Department of Public Health and <br />Environment Water Quality Control Act, (215-8-101 et seq., CRSD) the City of <br />Louisville is required to adopt and implement an ordinance for the Stormwater Program. <br />The storm water program addresses water quality concerns from storm water runoff and <br />establishes methods for controlling the introduction of pollutants into the storm drainage <br />system and reduces the amount of pollutants that may discharge into our waterways. <br />Adoption of the ordinance will also regulate and monitor all construction activities that <br />disturb one or more acres of land, as well as activity that disturbs less than one acre but is <br />part of a larger common plan of development. Sediment, debris or other pollutants from <br />construction operations must be managed to prevent flow to the storm drain system. The <br />regulations and control mechanisms are a requirement of our community's Municipal <br />Stormwater Discharge Permit issued by the State of Colorado. <br /> <br />Mayor Sisk opened the public hearing and asked if anyone in the audience wished to <br />speak for or against Ordinance No. 1460, Series 2004. There were no comments. <br /> <br />COUNCIL COMMENT <br /> <br />Council member Keany asked if the ordinance would make sump pumps illegal. Public <br />Works Director Phare stated it could be illegal if there was a discharge of detergents or <br />pollutants. <br /> <br />Council member Keany asked if dumpsters would be required to be closed. Public <br />Works Director Phare stated they could if pollutants were released. He stressed the <br />Public Works Staff would present public information on those issues. <br /> <br />Phare introduced Ken Mason, Waste Water Plant Superintendent, who would also <br />participate in the City's public informational programs. <br /> <br />Council member Keany suggested a public information video be placed on the <br />government channel. Phare stated that such an educational video is being made. <br /> <br />Mayor Sisk requested public comment and hearing none, closed the public hearing. <br /> <br />MOTION: Council member Brown moved for Council approval of Ordinance No. 1460, <br />Series 2004, seconded by Council member Van Pelt. Roll call vote was taken. The <br />motion passed by a vote of 6-0.
