Louisville Local Licensing Authority <br />Meeting Date: February 24, 2003 <br />Page 3 of 5 <br /> <br />Chairperson Lipton wondered how long the application process in Boulder would <br />take. Authority Attorney Bleau stated that it would probably be a lengthy process <br />due to the applicant recently finding out that he will need to change the class of <br />his license in Boulder. Deputy Clerk Schmidt added that the temporary license <br />issued is valid for four months and can be extended if necessary. <br /> <br />Member Wilson noticed that the diagram submitted by MARSCO, LLC, d/b/a <br />Karen's Country Kitchen did not include the area where liquor is stored. <br />Detective Gordanier stated that the last time she did an inspection of the facility; <br />the liquor was stored in the basement. If that is the case, the applicant will need <br />to provide a diagram of the premises that includes the basement. <br /> <br />Member Kimmett had a question regarding the landlord and expiration date of <br />lease for applicant. Deputy Clerk Schmidt stated that she did not have a copy of <br />the lease when she made copies of the application. Member Kimmett also had a <br />question about ownership. It is unclear what the percentages are between the <br />application and the operating agreement. Member Mulvahill stated the <br />membership interest included in the operating agreement might be for profits and <br />losses not necessarily the interest in the business. <br /> <br />Member Mulvahill moved to table this item until the next Authority meeting so the <br />applicant can collect all the information needed. Member Wilson seconded the <br />motion. Roll Call Vote: Lipton-yes, Koertje-yes, Kimmett-yes, Paige-yes, Wilson- <br />yes. All members were in favor, motioned carried. <br /> <br />Renewal Application - Byung U. Min, d/b/a Little Tokyo - Beer & Wine Liquor <br />License- 332 McCaslin Blvd. <br /> <br />Chairperson Lipton informed the Authority that Little Tokyo is in arrears on sales <br />tax payments. She continued that the last time the Authority dealt with <br />delinquent sales tax, it was brought to the Authority's attention much sooner. <br />Chairperson Lipton was concerned that the information regarding sales tax <br />wasn't brought up before. Authority Attorney Bleau stated that it is the Finance <br />Department's decision when to take action on a delinquency. She added that a <br />Show Cause Hearing could be issued for the violation or a letter could be written <br />outlining the course of action the Authority would take on this matter. <br /> <br />Chairperson Lipton commented that another establishment had its liquor license <br />taken away for being delinquent on sales tax. Member Kimmett stated that there <br />were other factors that played a part in that decision. <br /> <br />Member Kimmett wondered if Little Tokyo still had a valid liquor license since the <br />current one expired on February 19, 2003.
