SUBJECT: DISCUSSION -PROPOSED AMENDMENTS TO CITY CODE REGARDING <br />OPEN BURNING, FIRE PITS, AND PORTABLE FIRE PLACES <br />DATE: SEPTEMBER 9, 2008 <br />permit to be burned any trash., paper, rubbish, wastepaper, wood, weeds, brush, plants, <br />or other combustible or flammable material anywhere in the city limits, except when: <br />a) The burning is in the course of an agricultural operation in the growing of crops as a <br />gainful operation and presents no fire hazard to other property in the vicinity. <br />b) The burning is a smokeless flare or a safety flare used to indicate danger to the <br />public. <br />c) The burning is a training fire conducted by the fire department, or is a training fire <br />conducted by another fire department, or privately for industrial or commercial fire <br />training purposes. <br />d) The burning is solely for the purpose of fuels mitigation to alleviate wildland fire <br />potential or weed abatement to assist restoration of native vegetation. <br />2) Burning wood in mobile or portable fire places, fire pits, or chimineas is prohibited within <br />the city limits. The burning of wood as the source of heat for cooking in any type of <br />device is prohibited. (Nothing in this ordinance is intended to prohibit the nonfuel use of <br />wood in cooking as a source of flavoring or curing.) <br />Recommended Language -Section 308: Open flames <br />1) Charcoal burners and other open flame cooking devices shall not be operated on <br />combustible balconies or within 10 feet of combustible construction with the exception: <br />a) Single family dwellings. <br />b) Where buildings, balconies and decks are protected by an automatic sprinkler <br />system. <br />FISCAL IMPACT: <br />Staff anticipates that clarifying the code requirements as proposed will reduce but not eliminate <br />the volume of questions and complaints that the Fire District and the City receive regarding <br />open burning. Consequently, staff estimates that implementing these changes will have no net <br />fiscal impact on the District or the City. <br />RECOMMENDATION: <br />Staff recommends that the City Council amend the Louisville Municipal Code as proposed. <br />ATTACHMENT(S): None <br />
