He took the beverage back inside to a bartender <br />and noted the staff on hand consisted of two female bartenders and Mr. Yen. He <br />noted there were approximately 110-120 persons in the bar. Officer Murlowski <br />reviewed his timeline of events. He recounted the number of alcoholic <br />beverages seen outside as five. Mr. GoIlin presented the exhibits to the Authority <br />— 1. Body cam video 2. Timeline 3. Diagram of premises 4. Summons issued to <br />Mr. Yen. No objections from Mr. Johnson. <br />Mr. Johnson thanked Officer Murlowski for his professional and calm handling of <br />this situation as noted on the body cam footage. Officer Murlowski noted the <br />alcohol seen outside by the officers was not all captured on video. He noted he <br />has seen similar crowds at other establishments in Louisville. He felt Mr. Yen <br />took some time to call last call and take care of the overcrowding. Mr. Johnson <br />asked if it took roughly an hour for the bar to be cleared out and closed. Officer <br />Murlowski agreed. <br />Authority members asked questions of Officer Murlowski concerning occupancy <br />and observance of alcohol outside the establishment. Officer Murlowski stated <br />there are signs near the front and back door stating no alcohol beyond this point. <br />Chairperson Carlson called for closing statements. <br />Mr. GoIlin noted there had been an admission to paragraph A of the show cause <br />notice concerning removal of alcoholic beverages from the premises. He noted <br />this is the establishment's fourth violation within a year. They have served a 10 <br />day suspension and an 11 day suspension. <br />Mr. Johnson noted Mr. Yen was surprised by the number of patrons that evening <br />and does want to cooperate with the Authority. Mr. Johnson noted from his <br />perspective, the premises were relatively orderly given the crush of college kids <br />that showed up. He felt an hour to get the bar closed down was not so <br />egregious. He noted the establishment had not had any violations for many <br />years. In the last year Mr. Yen has had some issues he is addressing. Mr. Yen <br />has hired an off duty law enforcement officer and more aggressive bartenders. <br />Mr. Johnson did not want to see penalties not in line with what actually occurred <br />that evening at the establishment. <br />Lipton noted there should have been an expectation of increased crowds during <br />a holiday weekend. She noted the outside of the premises had never been <br />included in Henry's service area. She did not feel the establishment was <br />controlled. <br />It was noted there are seven days held in abeyance from the last hearing. Mr. <br />Johnson wanted it noted the closing of the establishment takes a tremendous toll <br />on the business and staff. <br />
