Local Licensing Authority <br />Minutes <br />January 22, 2018 <br />Page 5of6 <br />Machado asked about staff training. Secretary Hanson reported 9 members of <br />Henry's staff attended training in September. <br />Chairperson Carlson asked for any other matters and hearing none, closed the <br />hearing. <br />Carlson noted there were at least two occurrences of alcohol outside the <br />premises noted on the videos and more purported from the testimony. He noted <br />the video showed a calmer scene than he had envisioned from reading the <br />report. He commended the officers on their calm demeanor. <br />Authority members discussed what choices could have been made to reduce the <br />number of patrons in the establishment. Members discussed whether there was <br />a violation of conduct of the establishment noted in paragraph B of the show <br />cause order. <br />Carlson moved sufficient evidence had been presented to support paragraph A <br />of the show cause order and that the Authority Attorney be directed to prepare a <br />draft of final findings, conclusions and order for the next meeting to be held on <br />February 26, 2018 and moved to continue the matter until that time. <br />Members discussed what would be a proper penalty. <br />Lipton moved there be 14 days of suspension plus the 7 days held in abeyance <br />to be served. The motion failed for lack of a second. <br />Members continued to discuss the penalty. <br />Lipton moved the Authority impose 11 days of suspension plus the 7 days held in <br />abeyance to be served. The motion failed for lack of a second. <br />Authority Attorney Culley said the prosecuting attorney noted the 7 days in <br />abeyance were ordered after the date of this violation so could not be added to <br />this penalty. <br />Watson moved the Authority order a suspension of 14 days with 7 days held in <br />abeyance. Carlson seconded. Authority Attorney Culley clarified there are now <br />14 days held in abeyance as there were already 7 from the last sentence. <br />Roll Call Vote: Machado — yes, Carlson — yes, Lipton — no, Watson — yes and <br />Scriggins — yes. <br />C.
