There <br />isn't public access around the fence area. Mr. Sinprasong passed around a floor <br />plan that shows the area surrounded by landscape. <br /> <br />Ms. Reester asked Mr. Sinprasong to explain what type of alcohol will be served <br />at his restaurant. He stated that he would only be serving beer and sake. He <br />expects less than 5% of his sales will be from alcohol. <br /> <br />Mr. Sinprasong explained the duties of the manager to include control of the <br />inventory, liquor, food and the dinning room. He stated he is knowledgeable with <br />the Colorado liquor codes. <br /> <br />Mr. Sinprasong stated he had an opportunity to open a new restaurant in <br />Louisville to become part of the community and to make it more convenient for <br />people who live here to dine at his restaurant. <br /> <br />Chairperson Lipton asked Mr. Sinprasong if he intended on being the manager at <br />the Louisville restaurant. Mr. Sinprasong stated that he would be the manager of <br />the new restaurant as well as continue being the manager of the other locations. <br />Attorney Harrington informed him that according to Colorado state laws, a <br />registered manager could only be manager of one location holding a Hotel & <br />Restaurant Liquor License. Ms. Reester stated she has advised Mr. Sinprasong <br />of this law and he is actively looking for managers for his locations in Boulder and <br />Broomfield. Chairperson Lipton asked what the anticipated date of opening <br />would be. Mr. Sinprasong stated that the restaurant should be opening some <br />time in the fall. <br /> <br />Member Sackett asked if Mr. Sinprasong could wait until the restaurant opened <br />to appoint a new registered manager. Attorney Harrington replied that once a <br />liquor license has been approved by the State, the registered manager becomes <br />active regardless of whether or not the restaurant has opened. <br /> <br />Member Kimmett asked if the delay of the Broomfield liquor license was due to <br />similar circumstances. Ms. Reester stated that it was a similar situation. <br /> <br />Member Wilson stated that there were four places in the lease that specified the <br />patio as communal property. She read a paragraph from the lease that states <br />the patio is for non-exclusive use by customers for outdoor dinning. Ms. Reester <br />stated that Mr. Sinprasong has received approval from the landlord to make the <br />patio exclusive. The only access to the patio would be through the restaurant. <br />Member Wilson asked if the lease would need to be modified to reflect the <br />exclusive use of the patio.
