Sec. 8.64.035. - Composting —handling and collection requirements. <br />A. All compostable materials shall be drained of liquid before being <br />deposited for collection. <br />B Compostable matenals containers shall be provided by the city or <br />its contractor Such containers shall be used only for the collection of compostable <br />materials. <br />C. Each hauler providing compostable materials containers may also <br />establish such reasonable and industry accepted requirements, rules, or regulations <br />for the separation and preparation of compostable material as are necessary to <br />provide for its orderly collection. Except for materials not properly prepared for <br />composting, haulers may not dispose of compostable materials set out for collection <br />by their customers by any means other than delivery to a lawfully operating <br />compostables processing facility <br />D No person shall place, leave, deposit or dispose of any compostable <br />matenals on any street, alley, or other public place, or on any private property, <br />unless the compostable materials are wholly contained within a compostable <br />materials container Any accumulation of compostable materials in violation of this <br />chapter is declared to be a nuisance and is prohibited. <br />E. Compostable matenals containers shall be kept off the street, curb, <br />sidewalk and all other public ways, except for the period beginning 6.00 p.m. on <br />the day prior to the day of collection and ending 9.00 p.m. on the day of collection. <br />Section 6. Section 8 64 040 of the Louisville Municipal Code is hereby amended to <br />read as follows (words added are underlined, words deleted are strreken4lifeigh) <br />Sec. 8.64.040. — Refusei and recycling and . compostable materials <br />responsibility <br />A. Refuse,. and recycling and compostable materials shall be gathered, <br />deposited, disposed of, and placed in the manner provided for in this chapter by the <br />owner, tenant, or occupant of the property, or the agent or contractor of any of the <br />foregoing, and each of the foregoing persons may be held jointly and severally <br />liable for any violation of this chapter <br />B It shall be unlawful for any person to set out or allow to be set out, <br />deposited, or stored for collection any refuse,. Of recycling or compostable matenals <br />other than that which has accumulated from the regular residential use of the <br />premises upon which such refuse or recycling materials are set out, deposited, or <br />stored for collection. <br />Ordinance No. 1766, Series 2018 <br />Page 4 of 9 <br />
