association terminates such services to its_residents, the homeowners' association <br />shall provide written notice to the. City within thirty (30) days. However, <br />homeowners' associations may participate in the city's residential refuse and single - <br />stream recycling collection program, subject to the requirements set forth in this <br />chapter <br />Section 10. Section 8 64 080 of the Louisville Municipal Code is hereby amended to <br />read as follows (words added are underlined, words deleted are stfisken-threugh) <br />Sec. 8.64.080. — Refus; and recycling and compostable materials hauling. <br />Nothing in this chapter shall prohibit any person from contracting for or <br />hauling their own refuse, and recycling and compostable materials provided such <br />refuse and materials are collected and disposed of in conformity with all applicable <br />city rules and regulations. <br />Section 11. Section 8 64 090 of the Louisville Municipal Code is hereby amended to <br />read as follows (words added are underlined, words deleted are strislen-threugh) <br />Sec. 8.64.090. - Residential refuse1 and single -stream recycling, and <br />d <br />compostable materials collection services fees. <br />A. City council shall, by resolution, establish the fees to be imposed for <br />residential refuse1 and single -stream recycling and compostable materials <br />collection services. The fees may be combined into one fee and shall be imposed <br />on all city residents receiving city water service not excluded from this chapter <br />pursuant to section 8 64 070, regardless of whether the city's residential refuses and <br />single -stream recycling and compostable materials collection services are actually <br />utilized by such resident. The fees shall be billed in conjunction with the charge for <br />city water service and such fees shall be due and payable at the same time and place <br />as the charge for water service. <br />B The fees for residential refuse and single -stream recycling and <br />compostable materials collection services and the charge for water service are <br />hereby declared to be parts of one debt to the city insofar as the same affect any one <br />owner, tenant or occupant, and the refusal or failure to pay any part of such debt for <br />any penod of service shall be sufficient cause for the city to avail itself of any or <br />all remedies as set forth and in accordance with the provisions of <br />sections 13 12.110 and 13 12.120 of this Code; provided, however, that water <br />service shall not be disconnected for nonpayment of the collection services fees, <br />and delinquent collection services fees shall not be recorded or certified as a lien <br />against the property except in the manner allowed to judgment creditors generally <br />for civil judgments entered upon a civil action for collection of debt. <br />Section 12.
