Board of Adjustment <br />Meeting Minutes <br />December 21, 2016 <br />Page 4 of 6 <br />Latham replies that the previous owners built it. <br />Ritchie shows the neighborhood plat, noting that to the north and south are similar lot <br />sizes and the lots across the street are wider and deeper. <br />DeJong asks if the post was straight in the middle of the deck. <br />Latham states that it was leaning. <br />Elizabeth Rayburg, member of the public, adds that the stairs extend further than four <br />(4) feet. <br />Public Comments in Favor: <br />Elizabeth Rayburg, 445 Orchard Drive, voices her support. She is on the HOA for the <br />applicant's neighborhood and states that everyone in the neighborhood approved the <br />deck before they knew they had to go through a BOA procedure. <br />DeJong read an email included in the staff report from Vic Goldberg, 515 Orchard Drive, <br />in support of the application. <br />Public Comments Against: <br />None heard. <br />Closed Public Hearing and Discussion by Board: <br />Stuart agrees with staff findings. <br />Ewy notes that the application is a reasonable request and if the applicant's lot was <br />slightly smaller he could build a larger deck without a variance <br />Levinson and Leedy voice support as well. <br />Campbell outlines his concern that this property is not unique and states that he is <br />disinclined to approve the variance. <br />Ewy states that looking at the aerial view it appeared that the house was smaller than <br />adjacent houses, meaning the applicant's lot coverage was less than the neighbors <br />already. <br />Stuart concurs. <br />DeJong agrees with staff reasoning and notes the fact that the stairs will be moved to <br />the side of the deck. <br />Stuart makes a motion to approve 450 Orchard Drive, Case #VAR-0150-2018, a <br />request fora variance from Section 17.12.040 of the Louisville Municipal Code <br />
