Board of Adjustment
Meeting Minutes
December 21, 2016
Latham replies that the previous owners built it.
Ritchie shows the neighborhood plat, noting that to the north and south are similar lot
sizes and the lots across the street are wider and deeper.
DeJong asks if the post was straight in the middle of the deck.
Latham states that it was leaning.
Elizabeth Rayburg, member of the public, adds that the stairs extend further than four
(4) feet.
Public Comments in Favor:
Elizabeth Rayburg, 445 Orchard Drive, voices her support. She is on the HOA for the
applicant's neighborhood and states that everyone in the neighborhood approved the
deck before they knew they had to go through a BOA procedure.
DeJong read an email included in the staff report from Vic Goldberg, 515 Orchard Drive,
in support of the application.
Public Comments Against:
None heard.
Closed Public Hearing and Discussion by Board:
Stuart agrees with staff findings.
Ewy notes that the application is a reasonable request and if the applicant's lot was
slightly smaller he could build a larger deck without a variance
Levinson and Leedy voice support as well.
Campbell outlines his concern that this property is not unique and states that he is
disinclined to approve the variance.
Ewy states that looking at the aerial view it appeared that the house was smaller than
adjacent houses, meaning the applicant's lot coverage was less than the neighbors
already.
Stuart concurs.
DeJong agrees with staff reasoning and notes the fact that the stairs will be moved to
the side of the deck.
Stuart makes a motion to approve 450 Orchard Drive, Case #VAR-0150-2018, a
request fora variance from Section 17.12.040 of the Louisville Municipal Code
