CLERK: It doesn't matter.

JOSS:

Actually, I would call an individual first. Joy Armstrong is she present this
evening? Would you step to the podium. Would you state your name,
occupation, and address.

ARMSTRONG:

Joleen Armstrong, waitress at Gentleman Jim's, 5390 W. 80th, Apt. 208A,
Westminster.

CLERK:

Please raise your right hand. Do you solemnly swear or affirm under penalty of
perjury that the testimony you are about to give will be the truth, the whole truth
and nothing but the truth?

ARMSTRONG: Yes.

Joss questioned Armstrong regarding her employment with Gentleman Jim's. It was established that
Armstrong had been employed by Gentleman Jim's on and off for about two years and that she worked
approximately 30 hours a week. Joss also established that Armstrong was employed by Gentleman Jim's
and working on the evening of December 7, 1995.

Joss established that Armstrong prior to the December 7, 1995, date had as an employee of Gentleman
Jim's received training fi.om the ownership concerning her responsibliities as a waitress. Armstrong had
attend a liquor training session. Armstrong stated that the class taught how to identify intoxicated people,
false I.D.'s. It was a four hour class. Armstrong did not recall the date of the class or who put on the
class, but thought it was about one year ago.

JOSS:

Calling your attention again to the evening of December 7, 1995, what time did
you go to work that evening, do you remember?

ARMSTRONG: Around 4:30 p.m.

JOSS:

How long did you work?

ARMSTRONG: I got offbetween 9 and 9:30. No, actually it was 9:30 - 10:00 p.m. that night.

JOSS:

You said you worked as a waitress. Is that a cocktail waitress or food service
waitress or both?

Mr. Joss asked Ms. Armstrong is she knew Darren Albright, Marvin Counts, or Jamie Abeyta. Ms.
Armstrong did not know any of the people. On that particular evening Ms. Armstrong remembers an
altercation in Gentleman Jim's. Ms. Armstrong remembered two men who she had served being
involved in the altercation. Mrs. Armstrong stated that the two men had been at the bar for approximately
1 and one-half hours. The altercation occurred around 9:15 p.m.. Mr. Joss clarified that the two men had
been in the bar since 8:00 p.m. or before and Mrs. Armstrong agreed. Mrs. Armstrong stated that she
had served the two men throughout the evening. Ms. Armstrong does not remember either of the two men

6
