BEATRICE: <br /> <br />There are only two other location in the mall that have beer and wine licenses and <br />they have exterior entrances, Round the Comer and another pizza location. <br /> <br />HERBERT: <br /> <br />There is not that much demand in Crossroads Mall for beer and wine. People just <br />want to shop and a quick bite to eat. While the other Abo's is more of a family <br />dinning area where people would like to sit down and eat and have a beer or a glass <br />of wine. <br /> <br />VICE <br />CHAIR: <br /> <br />Where are the two Abo's in Boulder that have beer licenses? <br /> <br />BEATRICE: <br /> <br />There is one in north Boulder on Iris, Willow Springs Shopping Center and the other <br />one is on Pearl Street near the Daily Camera. <br /> <br />KIMMETT: <br /> <br />You have no interest in either of these? <br /> <br />HERBERT: <br /> <br />No, those are separate owners. <br /> <br />There was lengthy discussion regarding Herbert's individual history. There were three charges against <br />Herbert, there were five charges on one and the latest one had two; running a red light and resisting arrest. <br />The first charge was theft and Herbert explained that it was when he was young, they had stolen a bicycle <br />tire. For the bicycle tire theft, Herbert served 16 hours of community service and 9 months deferred <br />sentence. Herbert gave his explanation of the assault charges. The four assault charges were all one <br />incident, all the assault charges were dismissed, the only charges that were deferred were the resisting arrest <br />and third degree trespassing. The illegal possession of a license was dismissed along with the assault <br />charges. <br /> <br />Resisting arrest was in combination with running a red light. Herbert explained that he was late going to <br />class and ran the red light, although he thought it was yellow and then preceded to go into the Arapahoe mall <br />to get movie tickets for later that evening. He parked and was running across the street to the theater when <br />the police call pulled up flashing his lights and jumped out of the car and pulled his gun and said "hold it." <br />Herbert did not see the police car until that time. None of the charges were alcohol related. <br /> <br />VICE <br />CHAIR: <br /> <br />Why didn't you list the other earlier convictions on the individual history? <br /> <br />HERBERT: <br /> <br />Because I thought I wasn't convicted, I read the information incorrectly. I thought <br />I only needed to list convictions and since all of them were dismissed, except for the <br />first one. I honestly forgot about the first one, about the bike tire. I did mention that <br />I am deferred right now. I just didn't mention about the convictions, on the second <br />one, which wasn't a conviction, because it was all dismissed. <br /> <br />RIGGINS: <br /> <br />It was a conviction, you admitted guilt to something and there were conditions that <br />were given to you that you had to complete. Upon completion of those conditions, <br />you no longer have a sentence that you have to comply with. <br /> <br />HERBERT: <br /> <br />So, I was convicted of this? <br /> <br />4 <br /> <br /> <br />
