City Council Special Meeting Minutes December 2, 2008 Page 7 of 18 Mayor Sisk commended the leadership of Councilors Muckle and Dalton on the Historic Preservation Tax Ballot Issue. Councilor Muckle thanked the Louisville voters for passing the ballot question. Mayor Sisk closed the public hearing. MOTION: Councilor Muckle moved to approve Ordinance No. 1544, Series 2008, seconded by Councilor Dalton. Councilor Dalton offered a friendly amendment to copy the language from the ordinance in paragraph B to paragraph D. Councilor Muckle accepted the amendment. VOTE: Roll call vote was taken. The motion carried by a vote of 7-0. RESOLUTION No. 59, SERIES 2008 - A RESOLUTION APPROVING A REQUEST FOR A SPECIAL REVIEW USE (SRU) TO ERECT, AND OPERATE A BUILDING MOUNTED, CMRS TELECOMMUNICATIONS FACILITY AT 315 SOUTH BOULDER ROAD -Public Hearing Mayor Sisk requested a Staff presentation. Planning Director Wood explained AT & T Mobility submitted an application to place nine roof-mounted, unscreened, antennas an the roof of the existing office building located at 315 South Boulder Road. Staff worked with AT & T to revise design elements of the request to incorporate screening of the antennae. The height of the existing building is 26'6". The overall height of the mounted antennae is approximately 32', which is less than maximum building height of 35'. The Planning Director issued an administrative approval for the building mounted CMRS in June of 2008; the building perrnit was approved in August of 2008 and finalized October 30, 2008. Based on a call from a tenant at 315 South Boulder Road, Staff reviewed the administrative approval and determined the administrative approval was issued in error. A building mounted CMRS in an AO zone district requires a Special Review Use. The Planning Commission held a public hearing on November 13, 2008 and approved a resolution of support with conditions. The applicant agreed to the conditions. The conditions are as follows: 1. The Special Review Use is granted to the applicant only. 2. The applicant shall provide an affidavit stating that "all applicable Federal Communications Commission (FCC) regulations regarding human health and exposure to radio frequency emissions shall be met."
