City Council <br />Special Meeting Minutes <br />December 2, 2008 <br />Page 7 of 18 <br />Mayor Sisk commended the leadership of Councilors Muckle and Dalton on the <br />Historic Preservation Tax Ballot Issue. Councilor Muckle thanked the Louisville <br />voters for passing the ballot question. <br />Mayor Sisk closed the public hearing. <br />MOTION: Councilor Muckle moved to approve Ordinance No. 1544, Series <br />2008, seconded by Councilor Dalton. <br />Councilor Dalton offered a friendly amendment to copy the language from the <br />ordinance in paragraph B to paragraph D. Councilor Muckle accepted the <br />amendment. <br />VOTE: Roll call vote was taken. The motion carried by a vote of 7-0. <br />RESOLUTION No. 59, SERIES 2008 - A RESOLUTION APPROVING A <br />REQUEST FOR A SPECIAL REVIEW USE (SRU) TO ERECT, AND OPERATE <br />A BUILDING MOUNTED, CMRS TELECOMMUNICATIONS FACILITY AT 315 <br />SOUTH BOULDER ROAD -Public Hearing <br />Mayor Sisk requested a Staff presentation. <br />Planning Director Wood explained AT & T Mobility submitted an application to <br />place nine roof-mounted, unscreened, antennas an the roof of the existing office <br />building located at 315 South Boulder Road. Staff worked with AT & T to revise <br />design elements of the request to incorporate screening of the antennae. The <br />height of the existing building is 26'6". The overall height of the mounted <br />antennae is approximately 32', which is less than maximum building height of <br />35'. The Planning Director issued an administrative approval for the building <br />mounted CMRS in June of 2008; the building perrnit was approved in August of <br />2008 and finalized October 30, 2008. Based on a call from a tenant at 315 South <br />Boulder Road, Staff reviewed the administrative approval and determined the <br />administrative approval was issued in error. A building mounted CMRS in an AO <br />zone district requires a Special Review Use. <br />The Planning Commission held a public hearing on November 13, 2008 and <br />approved a resolution of support with conditions. The applicant agreed to the <br />conditions. The conditions are as follows: <br />1. The Special Review Use is granted to the applicant only. <br />2. The applicant shall provide an affidavit stating that "all applicable Federal <br />Communications Commission (FCC) regulations regarding human health <br />and exposure to radio frequency emissions shall be met." <br />
