City Council <br />Meeting Minutes <br />December 16, 2008 <br />Page 9 of 14 <br />Teresa Peck, 1316 Franklin Avenue, Louisville, CO opposed the City's proposal <br />which takes away the resident's freedom of choice. She asked if there was a <br />way for citizen's to opt out of the program; the amount of the administrative fee <br />and who would service the containers. <br />There was a question regarding whether the proposal included moving boxes. <br />Mayor Sisk asked Public Works Director Phare to respond to the residents' <br />questions. Public Works Director Phare responded to residents' questions: <br />• Dumpsters and Commercials Service - ThE; state statutes precludes <br />commercial services from local residential :>ervices. The ordinance does <br />not address dumpsters for home remodel projects. <br />City Attorney Light confirmed the state statute excludes commercial, industrial, or <br />multi-family units of eight units or more. <br />• Shutting off water for non-payment of trash removal -The ordinance does <br />not have a provision for shutting off water for non-payment of trash <br />removal, however it does have a provision ifor liens against properties for <br />non-payment. <br />• CPI Price Adjustments -the rates will be reviewed annually. <br />• Pay-as-you-throw rates -the contract is a unit-based contract that are <br />intended to provide incentives for waste reduction and recycling. <br />• The RecycleBank -requires rear-loaded truck with weighing mechanisms <br />to weigh individual household. Currently side-loaded trucks are in use and <br />do not have such a mechanism to weigh recycled materials. <br />• Yard & garden wastes -accepted at the Waste Water Treatment Plant <br />seven days a week. Twigs, sticks and tree limbs are accepted at the drop <br />off center at the cemetery. <br />• Recycle Revenue -effective January 1, 2009 there will be no revenue to <br />communities for recyclables from the Boulder County Recycle facility <br />• Summer yard waste - a large container, in addition to the 96 gallon <br />container, can be ordered for $2.00 per month however those materials <br />will end up at the landfill. <br />• Opt-out options - No opt-out provision. Residents would be charged a <br />minimum rate for the 32 gallon container. <br />
