Local Licensing Authority <br />Minutes <br />September 23, 2019 <br />Page5of8 <br />Machado commented this was a serious incident. He noted there is a question <br />of what raises the incident to the level of a disturbance that needs reporting. He <br />felt earlier reporting could have tempered the fight. <br />Brown noted the lack of a policy to report disturbances and was encouraged to <br />hear the owner is looking to remedy that. <br />MOTION: Brown moved sufficient evidence had been presented to support the <br />following charges stated in the Show Cause Order: <br />Louisville Municipal Code § 9.22.050, stating that any licensee shall immediately <br />report to the City police department any unlawful or disorderly act, conduct, or <br />disturbance committed on the premises and that the Authority Attorney be <br />directed to prepare a draft of final findings, conclusions and an order for <br />consideration at the Authority's next meeting to be held on October 28, 2019 and <br />further moved to continue this matter until that time. <br />Kaufman seconded. Roll Call Vote: Kaufman — yes, Brown — yes, Machado — <br />yes. <br />Machado noted at the next Authority meeting there will be findings and order for <br />the Authority to consider along with a penalty. The Authority will also consider <br />any aggravating or mitigating circumstances when considering the penalty. <br />Machado noted the next item to be considered would be Item E concerning Tilt. <br />E. Show Cause Hearing — Tilt III LLC d/b/a Tilt — Lodging and <br />Entertainment Liquor License — 640 Main St. - 6/15/19 Incident <br />Mark Oberholzer, owner of Tilt, introduced himself to the Authority. Mr. Gollin <br />noted the City wished to withdraw this show cause order as he felt there was not <br />enough evidence to proceed. There is no direct evidence as to who drank the <br />alcohol shown on the receipts provided by Mr. Oberholzer. <br />Authority members discussed the proposed dismissal. Brown moved to accept <br />the dismissal of the show cause order. Machado seconded. All in favor. <br />D. Show Cause Hearing — Hei Han Enterprises Inc. d/b/a Henry's — <br />Tavern Liquor License — 935 Pine Street — 6/17/19 Incident <br />Prosecutor Gollin noted he would like to continue this to the October meeting <br />when the penalty is imposed on the other matter with Henry's. Mr. Yen was okay <br />with that. <br />Brown moved to continue this hearing until the October 28 meeting. Kaufman <br />seconded. All in favor. <br />F.
