development proposal. The applicant's engineer states that due to a reduction in 100-year flood <br /> flows, as a result of an upstream drainage-way mitigation project, the actual flood hazard zone is <br /> considerably smaller than what is shown on the FEMA map and 1301 Empire Road is actually <br /> outside of the actual flood hazard zone. However,because the City of Louisville acknowledges <br /> the October 4,2002 FEMA map as the official flood hazard map, the property is shown to be <br /> within the flood hazard area and must receive a floodplain permit prior to development. <br /> The FEMA Zone A as designated on the FEMA map as a special flood hazard area for which no <br /> base flood elevations have been provided. According to the applicant's engineer, Mr. Curtis <br /> Parker, Zone A areas were adopted for situations where a potential flood hazard is thought to <br /> exist based on topography or historical data. Although base flood elevations have not been <br /> provided, the City of Louisville is still responsible for insuring that new development within <br /> Zone A area are constructed using methods that will minimize flood damages. <br /> To determine the approximate flood elevation for this site, Mr. Parker obtained current <br /> topography mapping from the City. By comparing the adopted base flood elevations that exist <br /> for the AE zone west of Highway 42 to the current topographic mapping, a preliminary <br /> determination was made. By doing this analysis, it was determined that the nearest flood <br /> elevation is 5319 feet. <br /> FLOODPLAIN CRITERIA: <br /> The Board of Adjustment has authority to hear and decide, grant or deny this application for a <br /> Floodplain Development Permit pursuant to the powers granted the Board in § 17.48.110 of the <br /> Louisville Municipal Code. The Board may grant a permit only if it makes findings that all of <br /> the criteria, as established under § 17.56.160 A-F, have been satisfied, insofar as applicable. The <br /> following regulations shall apply in the flood regulatory district and all areas of special flood <br /> hazard: <br /> • 17.56.160 A. Flood District Encroachments: "The cumulative effect of any proposed <br /> development, when combined with all other existing and anticipated development, shall <br /> not increase the water surface elevation of the base flood more than one foot at any <br /> point. Certification by a registered professional engineer stating that any encroachment <br /> shall not result in such an increase in flood levels during the occurrence of a 100-year <br /> flood shall be required. " <br /> The attached analysis from the applicant's engineer, Mr. Curtis Parker, states "the <br /> proposed placement of fill will not imprudently reduce the flood-storage capacity of the <br /> waterway, will not encroach on the portion of the floodplain which would have <br /> significant flow during the 100-year flood, and will not reduce the hydraulic capacity of <br /> the waterway." <br /> Therefore, this criterion has been met. <br /> • 17.56.160 B Structures: <br /> 1.
