Lathrop moved that Council, with their comments, place Ordinance No. 1266, Series 1997, out for
publication and set the public hearing for October 21, 1997, seconded by Sisk. Roll call was taken.
Motion failed by a 1 - 6 vote with Davidson, Keany, Howard, Sisk, Mayer, and Levihn voting against.

ORDINANCE NO. 1267, SERIES 1997 - INCREASING THE SEWER TAP FEES IN THE
CITY OF LOUISVILLE, COLORADO - 1ST READING - SET PUBLIC HEARING 9/16/97

Tanoue read by title only Ordinance No. 1267, Series 1997, "An ordinance increasing the sewer tap
fees in the City of Louisville."

Tom Phare, Public Works Director, stated that this would raise residential sewer tap fees by $200 to
cover the cost of providing a waste water treatment for future residential developments.

Davidson called for Council comments, questions or motions.

Howard asked if once the increase were in place, would that affect the current Louisville residents.

Phare stated that it will not affect them unless they buy another sewer tap.

Sisk, referring to Section 1, Year Tap Purchased and Amount, that it should say "after the adoption
of the ordinance..." In reading it, it said to him there would be a back charge to those who had
already gotten sewer taps, which was not the intention.

Tanoue stated that the last line that states "1997 and thereafter" could be amended to reflect the
effective date of this ordinance.

Sisk moved that Council adopt Ordinance No. 1267, Series 1997, increasing the sewer tap fees in the
City of Louisville, 1 st reading, with the amendment indicating that the tap fees would increase to
$2720, with the effective date, upon adoption of the ordinance, set out for publication, and set a
public heating for September 16, 1997, seconded by Mayer. All in favor.

OTHER REGULAR BUSINESS ITEMS ARISING AFTER PREPARATION OF AGENDA

NONE

CITY ATTORNEY'S REPORT

Tami Tanoue, Griffiths & Tanoue, pointed out that there was a loose end with the Carson
Annexation. Council approved Resolution No. 40, Series 1997, setting the matter for a public
hearing in October. At the next Council meeting she would have a recommendation for what to do
with the loose end, since the corresponding Ordinance was not adopted.
