Mr. Dill had no other questions of the witnesses and asked if there were any Authority questions. Being
none, the witnesses were excused.

Mr. Dill asked Max Scott to present the survey information to the Authority.

The Secretary swore in Mr. Scott.

Mr. Max Scott of Oedipus Inc. conducted the survey for the application and made a presentation of the
results of the survey. He stated that the applicant, Mr. Richard Eisenberg, hired him to conduct a survey
of the needs and desires of the neighborhood. Mr. Scott circulated copies of the report to the Authority
members. He reviewed that the petition allowed the signors to sign for or against the application, and
make any comments they wished. He noted the survey reflected 386 signatures favoring issuance of the
license, 35 of which were businesses and 351 were residents. Those opposing the application, totaled 95,
9 of which were businesses and 86 were residents.

Mr. Dill asked for admission into evidence of the petitions and the statistical report.

Lipton asked Mr. Scott the date that he was hired to perform the survey.

Mr. Scott stated that he opened his file is dated March 24, 1999. The first contact was by Wal-Mart
Corporate Headquarters and later by Cody Mitchell, and Mr. Eisenberg. He believed that he was
contacted about three weeks prior to March 24, 1999.

Myers asked how many surveys Mr. Scott has done in Louisville.

Mr. Scott estimated that his company has completed between 20 and 30 surveys, for liquor application
purposes, in Louisville.

Jeffers asked if the numbers in this particular application would be considered good.

Mr. Scott stated that the survey results in the Sam's Club application are very good.

Mr. Dill then called Richard Dean Eisenberg.

The Secretary swore in Mr. Eisenberg.

Mr. Dill asked Mr. Eisenberg of his educational background, and his business experience.

Mr. Eisenberg stated that he holds a Bachelors Degree in Pharmacy from the University of Colorado,
Boulder. He stated that he has been in the retail liquor business for 25 years.

Mr. Dill asked what liquor stores had been owned or operated by Mr. Eisenberg.

Mr. Eisenberg stated that he operated Corona Wine and Spirits, in Denver for 20 years. Currently, Mr.
Eisenberg owns and operates Rocky Mountain Liquor Outlet, which is located inside the Sam's Club in
Aurora. He is selling the Aurora liquor store.
