Mr. Dill asked if Mr. Eisenberg felt there was a need for this type of license in Louisville.

Mr. Eisenberg stated there was a need for this type of license.

Mr. Dill asked Mr. Eisenberg to describe how the liquor store will be partitioned offfrom Sam's Club.

Mr. Eisenberg stated tat 45' lef~ of the entrance of the Sam's Club there is a wall, which will act as the
rear wall of the liquor store. A steel cage will be constructed for the other three walls, which will be
closed by a sliding 10'gate. The sliding gate will open towards the wall. There will be two checkout
counters in a configuration of an L. There will also be an office.

Mr. Dill asked the proposed hours of operation.

Mr. Eisenberg stated the hours of operation would be the same as Sam's Club, 9:00 a.m. to 8:30 p.m.
The late hours will adjust, with the hours of Sam's Club. During the holidays the hours are half an hour
later, so about 9:00 p.m. would be the latest. They would not compete with full service packaged liquor
stores.

Mr. Dill asked Mr. Eisenberg to describe the type of products that would be sold.

Mr. Eisenberg stated that the products would primarily consist of spirits in larger sizes, and wines and a
very large selection of white wine. There will also be micro-brews, miscellaneous items such as
glassware, openers.

Mr. Dill asked how the beer/wine would be displayed.

Mr. Eisenberg stated that tall steel would surround the area and down the center there is smaller steel
with shelves. Down the middle will be a horseshoe, which will hold the wines.

Mr. Dill asked when Mr. Eisenberg began negotiations with Sam's Club.

Mr. Eisenberg stated that Sam's Club had contacted him in March.

Myers asked the applicant if he had any understanding with Sam's Club that they would not sell 3.2%
beer.

Mr. Eisenberg stated that he would hope they would not. He knew of other Sam's Club that had this
type of combined 3.2% beer and retail liquor store and felt they were in competition with each other.
But he stated that he did not have any understanding with Sam's Club that they would not sell 3.2% beer.

Sergeant Riggins asked if Mr. Eisenberg ever had any employees who had liquor code violations.

Mr. Eisenberg stated that he personally had not had any violations, however in 25 years of business only
one employee had a liquor code violation of serving to a minor.

Sergeant Riggins asked Mr. Eisenberg what he considered to be the most common liquor code violations.

7
