Lipton inquired as to whether the emergency exit on the west side of the patio would be locked or have <br />an alarm that would sound if someone opened the door. She was concerned that patrons could leave the <br />restaurant with alcohol by way of the emergency door. <br /> <br />Lipton asked if he would be attending the local training sessions. <br />He stated that he would attend a training session and then educate his staff as to the liquor laws. He said <br />that he did not have any employees at this time. <br /> <br />Kimmett asked how Mr. Fan would check I.D.'s. <br /> <br />Mr. Fan stated that he would card everyone under thirty years of age. Mr. Fan explained that it was his <br />experience that families generally frequent Chinese restaurants, therefore the sale of alcohol is quite low. <br />He estimated that twenty to thirty percent of the profits would be derived by the sale of alcohol. <br /> <br />Jeffers suggested that because there has been some revision of the submitted diagram, the applicant <br />submit an updated diagram. He also noted that after the certificate of occupancy was granted by the City, <br />any revisions to the building would have to be approved by the Local Licensing Authority. <br /> <br />Lipton asked if there were any interested parties in the audience that wished to speak in favor of the <br />application. There were none. <br /> <br />Lipton asked the applicant if he wished to make any closing comments. <br /> <br />Mr. Fan had no closing comments. <br /> <br />Lipton closed the public heating and called for member discussion and comments. <br /> <br />Jeffers moved that the Local Licensing Authority of the City of Louisville find that the applicant is of <br />good moral character, that the inhabitants of the neighborhood desire the license be granted, that the <br />license will meet the reasonable requirements of the neighborhood, that all City and state law <br />requirements have been met and that, based on these findings, the Local Licensing Authority approve <br />issuance ora hotel and restaurant license for Spice China with following additional conditions: 1. Provide <br />an amended diagram of the licensed premises, showing the change of the interior wall and the location of <br />liquor storage closet, 2. That an emergency sound device be installed on the emergency exit for the <br />patio, similar to any emergency door, 3. That in addition to the owner, the bartenders and wait staff <br />attend liquor licensing classes either from Louisville or Lafayette within ninety days of hire. Evans <br />seconded the motion. Roll call vote: Lipton - yes, Myers -yes, Evans - yes, Kimmett - yes, Jeffers - <br />yes. All members were in favor, motion carded. <br /> <br />Mr. Fan stated that he would have to check with the Louisville Building Department to see what is <br />allowable by code for the emergency exit door. <br /> <br />Jeffers moved that the motion be amended to give the applicant the option to have the emergency door <br />either alarmed or locked. Myers seconded the motion. Roll call vote: Evans - yes, Kimmett - yes, <br /> <br />5 <br /> <br /> <br />
