Louisville Local Licensing Authority
Meeting Date: May 8, 2000

Chairperson Myers asked members if they had any questions for Ms. Ronacher.

Kimmett questioned the diagram provided by the applicant, specifically that it included the entire
premises, inside and out. Ms. Ronacher responded that guests are permitted to carry a beverage to
their room or to other recreational areas such as the Sports Court and patio. Kimmett asked what
types of controls are in place to prevent a guest from carrying an alcoholic beverage out to the
parking lot. Ms. Ronacher stated that there are Mangers and Sales staff at the hospitality receptions
who monitor the movement of guests during the two-hour period.

Chairperson Myers asked Ms. Ronacher to point out the patio on the diagram. Members discussed
the diagram in detail reviewing parking, landscaping, fencing, entrances, exits and sidewalk areas.

Jeffers noted that the diagram seems to include a perimeter area around the entire building and asked
Ms. Ronacher to describe the outside property. Ms. Ronacher stated that the entire perimeter of the
building has a sidewalk and is surrounded by river rock landscaping. Further, she added, there are no
guestroom doors or patios that exit to the outside of the building or provide access to the sidewalk.

Chairperson Myers clarified that the intent of the Authority is to license only that portion of the
premises that the Authority feels the applicant can reasonably control, and therefore certain
modifications to the proposed diagram may be necessary.

Attorney Spielman stated that the Authority has identified certain valid concerns on the proposed
licensed premises, however, the applicant is interested in maintaining the character and tradition of
service and amenities offered by Residence Inn by Marriott.

Chairperson Myers asked Ms.. Ronacher who would be serving beer and wine to guests and would the
guests be able to serve themselves. Ms. Ronacher responded that the person working the gatehouse
would be responsible for serving beverages and ultimately for ensuring no one is over served. She
also stated that guests would not be allowed to serve themselves.

Authority Chairperson Myers requested Attorney Spielman to call his next witness. Mr. Spielman
called on Mr. Max Scott to give testimony.

Mr. Scott stated he is the owner and operator of Oedipus, Inc., located in Boulder. He explained that
Oedipus performs survey and site location work throughout the state for liquor license applicants.
Mr. Spielman asked Mr. Scott if the applicant paid him for the survey. Mr. Scott responded that
payment had been received by the applicant in advance and was not based on the survey results.

Mr. Scott briefly described the survey procedure and petitions used, the results of which were
compiled in a report and submitted to the Local Licensing Authority. Mr. Spielman requested the
report and petitions be entered as evidence for the record. Chairperson Myers stated that the petitions
and report provided by Oedipus, Inc. would be entered as evidence for the record.

Mr. Scott summarized the results of the survey and commented that the approval rating of 98% was
quite high and has only occurred in approximately thirty other liquor licenses surveys in which

\LFRED\VARRAN~LIQUOR~2000WIINUTESWIINUTES050800.DOC
