Dillon Road. <br /> <br />Turner motionedto set the Boundaries of the Neighborhood for the applicationaS the city limits <br />of Louisville, CO and that the date for the Public Hearing be s r the y sCheduled <br />meeting ,2000 at 7:00 P.m. in the Council Chambers on the 2nd floor of the~City Hall <br /> <br />on passed. <br /> <br />Present at the meeting on behalf of the applicant were Mr. David Kerscher and Ms. Reean <br />Waddle of Wahoo's Fish Taco. <br /> <br />Ce <br /> <br />Stipulation and Agreement - Hei Han Enterprises, Inc., d/b/a Henry's Bar & Grill - <br />Tavern Liquor License - 935 Pine Street. <br /> <br />Appointed Special Prosecutor, Steve Barnett presented the Stipulation and Agreement for Hei <br />Han Enterprises, Inc., d/b/a Henry's Bar & Grill. Prosecutor Barnett stated the facts in the case <br />and summarized the follow-up investigation concerning the alleged allegations concluding with <br />the fact that while the licensee has been before the Authority in the past, there have been no <br />violations within the last twelve months. <br /> <br />Prosecutor Barnett continued by proposing to the Authority a Stipulation and Agreement that <br />would impose a five (5) day suspension with three (3) days served continuously to include a <br />Friday or Saturday within the next thirty (30) days and two (2) days held in abeyance for a <br />period of one (1) year. The proposed Stipulation would acknowledge that there was a violation <br />on April 15, 2000. <br /> <br />There was discussion by members as to the length of the suspension and days to be served. <br /> <br />Prosecutor Barnett stated that although the licensee is responsible for monitoring and <br />maintaining control of the entire premise, it appears the bartender refused to sell alcohol and <br />attempted to prevent others from purchasing alcohol for the parties involved. In his opinion, this <br />conveyed knowledge of the situation and attempts to control it. <br /> <br />Sergeant Riggins commented that while the licensee had problems in the past, corrective action <br />was taken including staff changes, training and compliance with all terms previously imposed by <br />the Authority and City Prosecutor. <br /> <br />Chairperson Myers stated his concern over how to fairly treat repeat offenses by licensees who <br />have shown improvement but nevertheless end up back before the Authority. <br /> <br />Member Kimmett and Chairperson Myers proposed an eight (8) day suspension, three (3) days <br /> <br />3 <br /> <br /> <br />
