Louisville Local Licensing Authority <br />Meeting Date: July 31, 2000 <br />Page 4 <br /> <br />Noodle Shop Co., Inc., has ever been convicted of a crime, excluding minor traffic violations. <br />Mr. Weigand responded that to his knowledge they have not. <br /> <br />Chairperson Myers then asked if Mr. Weigand would agree that should the Authority proceed <br />with the heating tonight on their application, that the Authority may revoke any approval granted <br />if the Individual History Records and fingerprint cards for the additional persons reveal they <br />have been convicted of a crime, excluding minor traffic violations. Mr. Weigand stated full <br />agreement and understanding of the Authority's conditions. <br /> <br />Attorney Kelly questioned whether a history of operations in other cities exists for The Noodle <br />Shop Co., Inc., stating that this information would be beneficial to the Authority in making a <br />determination on whether to move forward with the hearing conditionally. <br /> <br />Mr. Weigand stated that The Noodle Shop Co., Inc. has been in operation since 1995 with their <br />first store located in Denver, Colorado. He continued that they now have eleven stores located in <br />three different states all currently holding liquor licenses. Mr. Weigand stated to the Authority <br />that none of the stores have ever received a liquor violation and noted that sale of alcohol <br />accounts for a very small percentage of their total sales at approximately 2%: Mr. Weigand <br />offered that this was first Local Licensing Authority to request Individual History Records of the <br />board and directors. He stated that had this been previously requested by any of the six other <br />AuthOrities they have appeared before in Colorado, the information would already be on file ~ <br />with the state and not an issue at this heating. <br /> <br />Attorney Kelly stated to members that she discussed this issue with the State Liquor <br />Enforcement Division and that Louisxfille is not the only Authority to require this information, <br />though it may be the first time it has been requested of The Noodle Shop Co., Inc. <br /> <br />Member discussion focused on whether it would be more procedurally correct to consider the <br />application complete and proceed with the public heating orwhether to find the application <br />incomplete and waive the requirement as stated in the Authority Rules of Procedure. <br /> <br />The Authority members expressed concern regarding whether if the application is considered <br />complete without the additional Individual History Reports or whether the application is <br />considered incomplete but the Authority chooses to proceed with the public hearing, precedence <br />inadvertently might be established. <br /> <br />Chairperson Myers stated his understanding of the applicant's position on the issue and noted <br />their willingness to comply with the Authority's conditions. <br /> <br />Member Jeffers stated that in his opinion, the ~tpplication submitted by The Noodle Shop Co., <br />Inc. is no less complete than other applications considered by the Authority prior to receiving <br />CBI reports. He suggested that the Authority give the applicant a deadline for submitting the <br />requested Individual History Records and fingerprint cards. <br /> <br />4 <br /> <br /> <br />
