Louisville Local Licensing Authority <br />Meeting Date: October 30, 2000 <br />Page 8 <br /> <br />results, and Ms. Henry to answer any questions concerning the restaurant. <br /> <br />Member Kimmett identified a discrepancy on corporate officer Lawrence Leith's individual history <br />record, which states his middle initial as "P" for Paul, and the master file letter from State Liquor <br />Enforcement, which indicated the letter "D." The same two documents also list conflicting dates of <br />birth for Mr. Leith, 9/6/59 and 10/1/62 respectively. <br /> <br />Mr. Wildberger stated that he did not have personal knowledge of Mr. Leith's actual birth' date, but that <br />he would submit a letter to the Authority with the correct information. <br /> <br />Vice Chairperson Lipton asked Mr. Wildberger why Tokyo Joe's applied for a hotel and restaurant <br />liquor license as opposed to a beer and wine license. Mr. Wildberger stated that the purpose is to remain <br />consistent with the type of license granted to existing Tokyo Joe's locations and that, should the <br />corporation decide to sell any restaurants, the value is higher with a hotel and restaurant liquor license. <br /> <br />Vice Chairperson Lipton asked for clarification on fencing materials and wiring to be used around the <br />outdoor patio area. Mr. Wildberger stated that a letter from the architect and a list of materials is <br />included in member packets and that the outdoor seating areas for this and other restaurants have been a <br />challenge. He noted differing requirements from county to county and city to city. He also stated that <br />many times, municipal rules directly conflict with that of the local Fire Marshall. <br /> <br />Member Kimmett asked how alcohol consumption in the patio area will be controlled. Ms. Henry stated <br />that their restaurants are small in size that there would always be three to four staff members on duty, <br />with one person cleaning tables and monitoring the restaurant. <br /> <br />Mr. Wildberger clarified that the gate in the patio area is wired such that people could exit in an <br />emergency but can not enter the patio area from the outside. The gate is not wired with an alarm. <br /> <br />Member Jeffers asked about question (6) on the state application which is marked "yes" indicating a <br />member'of the corporation or manager is under the age of twenty-one. Mr. Wildberger stated that the <br />children of one of the officers are stockholders however, the stock is held in a trust and is under the <br />guardianship of a trustee and the children have no access to this trust. Member Jeffers recommended <br />this question be amended to respond "no," as it appears that the trust is the stockholder, not the children. <br />Mr. Wildberger agreed that "no" was an accurate response to this question. <br /> <br />Chairperson Myers called Ms. Pietrs to come forward and speak to the needs and desires of the <br />neighborhood. <br /> <br />Ms. Pietrs greeted the Authority and stated she is Managing Director of Esquire Petitioning Service, <br />LLC in Denver, Colorado. Ms. Pietrs reviewed the summary report contained in member packets noting <br />that two petitions were circulated on October 14, 2000. Circulators focused on residents located within <br />the designated neighborhood and business managers and owners within the same designated area. The <br />circulators were instructed to state the purpose of the petition, indicate the address of the proposed <br />location, review the qualifications of those signing the petition, allow persons to sign in support or <br /> <br />8 <br /> <br /> <br />
