Louisville Local Licensing Authority
Meeting Date: January 29, 2001
Page 4

that the Coal Creek Golf Course is owned by the City of Louisville. The City has for the past ten years
employed Evergreen Alliance Golf Limited (EAGL), formerly Recreational Services Limited, to manage the golf
course.

Mr. Baysinger stated that the City put out an RFP late last year for the management contract of the golf course
that was due to expire with EAGL on January 1, 2001. Proposals were reviewed, interviews were conducted and
Western Golf Properties was awarded the contract. Since choosing Western Golf Properties, it was discovered
that the company does not wish to hold the required liquor license. Therefore, the City has applied for the
transfer of the liquor license to the City.

Director Baysinger continued that negotiations with Western Golf Properties should be finalized and the
agreement ready for Council approval at the February 6, 2001 meeting. Meantime, EAGL has submitted a
signed affidavit consenting to the transfer of the existing liquor license to the City of Louisville.

Member Jeffers asked who was currendy managing the golf course. Mr. Baysinger stated that the City of
Louisville is operating the golf course until the management contract with Western Golf Properties is signed.
Western Golf Properties will not sign the contract agreement if they are required to hold the liquor license.

Member Jeffers stated his opinion that the current licensee no longer has possession of the premises. Attorney
Kelly stated that was correct and that the Authority's normal course of action would be to order a Show Cause
hearing.

Mr. Baysinger stated that the head golf professional and the food and beverage manager have not changed and
are still working at the golf'course.

Member Jeffers asked if the City of Louisville had been issued a temporary permit. Deputy City Clerk Bolte
stated that a temporary permit would be issued January 30, 2001, and that the permit would be valid for 120
days.

Member IGmmett asked if Anthony Principato would continue as the registered manager for the golf course.
Mr. Baysinger stated that he would.

Member Jeffers asked how the management agreement could affect the transfer of the liquor license. Attorney
Kelly stated that the Authority should review the agreement to determine who will have control of the premises
and be responsible for the sales and service of alcoholic beverages.

Member Jeffers asked if Anthony Principato would be an employee of the City or Western Golf Properties.
Director Baysinger stated that he would be an employee of Western Golf Properties.

Member Jeffers stated that the individual history forms had not been properly completed. Attorney Kelly stated
that, as with all applicants, a letter oudining the deficiencies of the application would be provided to the City.

Member Jeffers asked Mr. Baysinger if the finalized contract would be available for the next Authority meeting.
Mr. Baysinger stated that the major issue remaining was resolving who would hold the liquor license. He stated
that other revisions, specifically indemnification for the City, were being drafted into the final contract by the
City Attorney and that this should be completed for Council approval February 6, 2001.

Sergeant Riggins asked if attendance at the liquor training sessions was mandated in the management contract.

\\FRED\VARRAN\LIQUOR\2001 \MINUTES\MINUTES012901.DOC
