Attorney Kelly stated that ultimately, it is up to the Authority to determine if <br />the evidence submitted by the applicant is sufficient to prove the needs and desires of the adult inhabitants of <br />the neighborhood and that petitions are often used by applicants to satisfy this, but there is no required format <br />for a person if one is used. <br /> <br />Member Jeffers asked the applicants if the people who signed the petition were aware that they were signing in <br />favor of a Beer and Wine liquor license for Abo's Pizza. Lizzette Sanabria stated that customers were informed <br />prior to signing that the petition was for obtaining a Beer and Wine license. <br /> <br />Vice Chairperson Lipton asked if the applicants have received any liquor training or have had experience in <br />selling alcoholic beverages. Beatriz and Lizzette Sanabria stated that they would attend the next available training <br />session. <br /> <br />Member Jeffers asked how the sale of beer and ,,vine will be controlled. Lizzette Sanabria stated that all patrons <br />must place their food and beverage order at the counter. She stated that ID's would be checked at the cash <br />register counter at the time of purchase. <br /> <br />Member Jeffers asked Beatriz or Lizzette Sanabria if they had an interest in any other Abo's Pizza restaurants. <br />Lizzette Sanabria stated that they used to have an Abo's Pizza at Crossroads Mall in Boulder but that it is closed. <br />Lizzette Sanabria stated that the Boulder Abo's never had a liquor license. <br /> <br />Vice Chairperson Lipton asked if the entire seating area could be monitored from the service counter to ensure <br />alcoholic beverages are not shared. Beatriz Sanabria stated that the seating area is very small and that the entire <br />area can be seen from the counter. <br /> <br />Member Kimmett asked if the diagram contained in member packets was accurate and whether the premises had <br />been modified. Beatriz Sanabria stated that the diagram is correct and that no modifications have occurred. <br /> <br />Member Jeffers asked the applicants to explain Herbert Sanabria's role and responsibilities with Abo's Pizza. <br />Lizzette Sanabria stated that Herbert Sanabria is no longer a shareholder of Sanabria Enterprises, Inc. Member <br />Jeffers asked if Herbert Sanabria has any other kind of business agreement with Sanabria Enterprises. Lizzette <br />Sanabria stated that Herbert Sanabria has no separate agreement with Sanabria Enterprises. Member Jeffers <br />asked if Herbert Sanabria worked at Abo's Pizza. Lizzette Sanabria stated that he does work at Abo's Pizza as a <br />pizza maker. <br /> <br />Member Kimmett asked what implications, if any, exist 5vith Herbert Sanabria listed as a guarantor on the lease <br />agreement. Attorney Kelly stated that the important issue is whether or not he is an owner in the business. <br />Kelly continued that many times other guarantors are named on a property lease, noting the recent application <br />for Little Tokyo, for xvhich background checks were not required by the Authority for all of the sublessors, just <br />the endty that will hold the liquor license. <br /> <br />Member Kimmett noted that the lease expiration date on the application of June 2001, needs to be revised to <br />reflect the new lease agreement expiration date of February 28, 2006. <br /> <br />Chairperson Myers asked the applicants if they understood the rules and regulations that prevent them from <br />selling to persons under the age of txventy-one and from selling to visibly intoxicated persons.
