Louisville Local Licensing Authority <br />Meeting Date: August 27, 2001 <br /> <br />incident be dismissed. Joss stated that he did feel there was evidence to support the remaining <br />charge of transferring alcohol to a visibly intoxicated person on April 27, 2001 and of selling <br />alcoholic beverages to a person under the age of twenty-one on June 29, 2001. <br /> <br />The proposed Stipulation and Agreement provides for the licensee to plead guilty to the charges and <br />incur a seven day suspension of the liquor license with three days served and four days held in <br />abeyance for the period of one year. The licensee has also agreed that all of their employees <br />involved in the sales of alcohol will attend the next scheduled liquor training session. Additionally, <br />all new employees would be required to attend the next available training session after their hire. <br /> <br />Attorney Joss stated that the dates of suspension to be served had been left blank on the proposed <br />Stipulation and Agreement and that Attorney Rennich would speak to the dates of suspension <br />proposed. <br /> <br />Attorney Rennich greeted the Authority and stated that his client, Romero's Liquors, proposes <br />Thursday, October 25tt~, Friday, October 26th and Saturday, October 27th, 2001 as the days of <br />suspension to be served and respectfully requested the Authority to approve the Stipulation and <br />Agreement. <br /> <br />Chairperson Lipton called for Authority questions or discussion. <br /> <br />Member KJmmett asked if any days were currendy being held in abeyance for any previous <br />violations. Attorney Harrington stated that the liquor license was transferred to Romero's Liquors, <br />Inc. approximately one year ago, and that although the first incident occurred earlier this year, all <br />three violations are contained in the Amender Order to Show Cause contained in the member <br />packets. <br /> <br />Member Jeffers asked Attorney Joss his reasons for recommending dismissal of the charges alleged <br />for the March incident. Joss stated that the incident involved police contact with an intoxicated <br />person walking along Highway 42. Joss stated the problem of proving that the person, who was <br />contacted approximately one mile from Romero's Liquor, did not obtain alcohol at another premise <br />prior to being contacted by the police. Additionally, there were no witnesses to this incident in the <br />liquor store at the time of the sale. <br /> <br />Chairperson Lipton asked how long it took for the licensee, Donna Romero, to contact the police. <br />Attorney Rennich stated that he did not know, but that they did eventually hook up. <br /> <br />Member Jeffers moved to accept the proposed Stipulation and Agreement for Romero's Liquors, <br />inc., d/b/a Romero's Liquors. Chairperson Lipton seconded the motion. Roll Call Vote: I4hmmett <br />- yes, Koertje - yes, Sackett - yes, Jeffers - yes, Lipton - yes. All members were in favor, motion <br />carried. <br /> <br />Show Cause Hearing - Bungalow Wine & Liquors, Inc., d/b/a Bungalow Wine & <br />Spirits - Retail Liquor Store License - 645 S.
