Louisville Local Licensing Authority <br />Meeting Date: August 27, 2001 <br /> <br />a residence at approximately 2:00 a.m. and a woman subsequently being transported to the hospital <br />for treatment of a facial wound. While at the hospital the woman's blood alcohol was checked and <br />reportedly in excess of .40. <br /> <br />Barnett stated that he interviewed the bartender and customer and that both concur that she was <br />served three "doubles" and then shut off along with her friend. Attorney Barnett stated that part of <br />the problem is the time factor. The customer and bartender agree that she left Druids Arms at <br />approximately midnight. The bartender stated that he closed the bar not long after she left because <br />it was a slow night. The police report indicates they received the call from the residence at <br />approximately 2:00 a.m., leaving a two hour window which cannot be accounted for. <br /> <br />Attorney Barnett stated that the woman has apparently developed a reputation for being a heavy <br />drinker, not just in the evening, but throughout the day. The police officer involved in the March <br />incident has since investigated this woman and has confirmed that she regularly carries a flask with <br />her. <br /> <br />Barnett stated that he recommends dismissing the charges based on the circumstantial nature of the <br />evidence he has obtained and his belief that the case is not strong enough to move forward. <br /> <br />Chairperson Lipton asked for any Authority questions or comments. <br /> <br />Sergeant Riggins stated that the Police Department has investigated this individual on numerous <br />occasions concerning similar circumstances. <br /> <br />Attorney Barnett noted that both the police officer with this incident and the bartender stated that <br />this individual has the ability to appear and function normally during and after consuming large <br />amounts of alcohol. <br /> <br />Member Jeffers stated he appreciated Attorney Barnett's time and efforts investigating this matter <br />and respects his opinion to dismiss the charges contained in the Show Cause Order. <br /> <br />Member Sackett concurred with Jeffers. <br /> <br />Member IGmmett moved to dismiss the Order to Show Cause dated May 21, 2001 for Celtic Way . <br />Ltd., d/b/a Druids Arms. Member Jeffers seconded the motion. Roll Call Vote: Sackett- yes, <br />Lipton - yes, Jeffers - yes, Koertje - yes, Kimmett - yes. All members were in favor, motion <br />carried. <br /> <br />Do <br /> <br />Corporate Report of Changes - American Legion Post No. 0111 - d/b/a American <br />Legion Walter Rhodes Post No. 0111 - Club Liquor License - 1130 Pine Street. <br /> <br />Members discussed that the representatives from the American Legion were requested to be present <br />at 8:30 p.m. and that since they were running ahead of schedule, would continue with item E and <br />return to item D once the representatives arrived. <br /> <br />E.
