Louisville Local Licensing Authority <br />Meeting Date: August 27, 2001 <br /> <br />request of Member Koertje, current Vice Chair, when all the Authority members were present. <br /> <br />Vice Chairperson Koertje stated that he ~vould continue in the position unless Member Jeffers was <br />interested in being Vice Chairperson. Member Jeffers stated that he has served as both Chairperson <br />and Vice Chairperson and believed it was good to have all members serve. <br /> <br />By unanimous consent members agreed that Michael Koertje continue as Vice Chairperson of the <br />Local Licensing Authority. <br /> <br />While still waiting for the representatives from American Legion, Member Sackett asked the other <br />members and staff about the Stipulation and Agreement for Romero's Liquors. Member Sackett <br />stated her opinion that the number of suspension days seemed too light. <br /> <br />Member Jeffers stated that other jurisdictions have stiffer penalties but that when a liquor store is <br />closed for three days there are no revenues, whereas a restaurant can still sell food items. <br /> <br />Member Jeffers voiced concern that the Licensee did not return the phone calls of the Police <br />Department, sentiments shared by all members. <br /> <br />VII. POLICE DEPARTMENT'S REPORT <br /> <br />A. Incident Report - Henry's Bar & Grill (tabled from 6/25/01 and 7/30/01) <br /> <br />Sergeant Riggins stated that this report was continued by the Authority at the June 25th meeting and <br />again at the July 30th meeting. Riggins stated that the report involves an individual who was <br />contacted by the police who stated he was drunk and had been drinking at Henry's Bar & Grill. His <br />BAC was .264, two and one half times the legal limit. <br /> <br />Riggins stated that a supplemental report written by Officer Waters was contained in the member <br />packets and had not been previously reviewed by the Authority. <br /> <br />Members discussed various aspects of the report including the purchase of "shots" by other patrons <br />for the intoxicated individual and the level of staffing at the establishment. <br /> <br />Sergeant Riggins stated that he and Officer Gordanier conducted a complete liquor training session <br />for all the employees of Henry's Bar & Grill at the request of the Authority earlier this year, and that <br />the bartender on duty at the time of this incident attended the training session. <br /> <br />Member Jeffers questioned why the individual was permitted to loiter on the premises. Jeffers <br />suggested ordering a show cause and appointing a special prosecutor to investigate the matter to <br />determine if there is evidence or witness testimony to support the allegations. <br /> <br />Member Jeffers moved to order a Show Cause hearing finding probable cause to believe that the <br />Licensee committed one or more violations of the following; C.R.S. [ 12-47-901(1)(a), stating in <br />pertinent part that it is unlawful for any person to sell, serve, give away, dispose of, exchange, or <br />deliver or permit the sale, serving, giving, or procuring of any alcoholic beverage to a visibly <br />intoxicated person; C.R.S.
