Louisville Local Licensing Authority <br />Meeting Date: August 27, 2001 <br /> <br />intoxicated person; Louisville Municipal Code [ 9.22.060, stating in pertinent part that no person <br />shall sell, serve, give away, dispose of, exchange or deliver, or permit the sale, serving, giving away or <br />procuring of, any malt, vinous or spirituous liquor to a visibly intoxicated person; Liquor Code <br />Regulafon 47-900(A), stating that any licensee, and any employee or agent of a licensee, shall not <br />permit the serving or loitering of an apparently intoxicated person. Member Jeffers also moved to <br />order the Show Cause hearing be held at its regularly scheduled meeting October 29, 2001, at 7:00 <br />p.m. in the 2"d floor Council Chamber of Louisville City Hall, 749 Main Street, Louisville, Colorado, <br />and that the Authority Attorney appoint a Special Prosecutor. <br /> <br />Vice Chairperson Koertie asked if it was possible to appoint a Special Prosecutor to investigate the <br />incident without ordering a Show Cause hearing. <br /> <br />Members and staff discussed the options available and determined that ordering a Show Cause <br />hearing was the most prudent course of action. <br /> <br />Chairperson Lipton seconded the motion. Roll Call Vote: Kimmett - yes, Jeffers - yes, Koertje - <br />yes, Sackett - yes, Lipton - yes. All members were in favor, motion carried. <br /> <br />Upon the arrival of the American Legion representatives, Chairperson Lipton call item D under <br />Authority Business back to the table. <br /> <br />Do <br /> <br />Corporate Report of Changes - American Legion Post No. 0111 - d/b/a American <br />Legion Walter Rhodes Post No. 0111 - Club Liquor License - 1130 Pine Street. <br /> <br />Mr. Leroy Lorenzi came forward and identified himself as the Commander at the American Legion <br />Post No. 0111. Also present was Legion member Bob Niffenegger. <br /> <br />Members asked Mr. Lorenzi why he did not disclose his previous alcohol related traffic violations on <br />his individual history report. Mr. Lorenzi stated that he did not intentionally omit the information <br />and that he did not realize he had to go back that far. Lorenzi stated that he is a family man now <br />and that those incidents are in his past. <br /> <br />Mr. Lorenzi continued stating that the current group of officers worked well together and that the <br />Legion was being run very well. <br /> <br />Members asked why Mr. Lucas and Mr. Garcia were not present at the meeting. Mr. Lorenzi stated <br />that Mr. Lucas was his cousin at that he had to work late at the Harley Davidson store. Lorenzi <br />stated that both men have stated they might step down from their positions. <br /> <br />Members discussed continuing this matter to the next meeting when both Mr. Lucas and Mr. Garcia <br />could appear and speak to the findings of their background investigations. <br /> <br />Mr. Niffenegger asked Attorney Harrington whether the Legion was insulated from liability because <br />they are a corporation. Attorney Harrington stated that it would not be appropriate for her to offer <br />the American Legion legal advice and stated that they should consult with their own attorney.
