Planning Commission
Meeting Minutes
May 8, 2008

Wood reviewed the three revised sections, listed below:
. Number of motor vehicles parked on private property
. Definition of Recreation Vehicle and Trailer
. Temporary Uses such as dumpsters

Tengler asked why the City of Fort Collins RVlTrailer Ordinance had been included.

Wood replied the RV Ordinance is similar to the Ordinance that the City of Louisville is
considering. The one concern of Staff is the Community Mediation component.

Bruce Goodman, Chief of Police, discussed the temporary parking of RVlTrailer on the
street. He stated the owner would need the permission of the property owner before
parking on the street.

Lipton inquired if the parking of RV's is covered in another section of the code.

Wood stated it is.

Lipton asked about the temporary storage in the right-of-way.

Wood stated it is by special permit issued by the Public Works Department.

Tengler reviewed the section of the Fort Collins ordinance regarding the right of entry
and asked if the City of Louisville can do this.

Goodman stated the City could not without owners consent.

Lipton asked about a warrant.

Goodman stated it could be done but a warrant requires a considerable amount of time
and work. He stated the City's enforcement is to do whatever the officer can see from
the street or adjoining property, with permission of that property owner.

Members of the Public:
Jim Gambino, 963 Eldorado Lane, Louisville, CO discussed the following points: 1)
motivation of the ordinance is of public safety, there aren't any public safety issues; 2) a
City mediator (volunteer committee) should be used instead; 3) number of vehicles
should be based on lot sizes and 4) should a waiver process be permitted to extend
past these regulations.

Howard Pollack, 834 Lincoln, Louisville, CO stated the following: 1) the City is looking at
a current ordinance that does not need to be fixed; 2) the ordinance appears to have
two different policies for parking on the street and 3) how will the number of nights
parked (14 nights in a 6 month time period) be monitored.

Teresa Peck, 1316 Franklin, Louisville, CO does not support an ordinance that governs
what a property owner can and cannot do on their property. There are other nuisance
laws the police department should be enforcing.

Carol Hill, 233 Jackson Cir., Louisville, CO stated she is a 30-year resident of Louisville
and does not support the ordinance. A mediation approach should be used. The
maximum number of vehicles should be dropped. The property they purchased was
bought because it had enough room for the vehicles they own.

Chuck Hill, 233 Jackson Cir., Louisville, CO stated the number of vehicles should be
dropped and consideration should be given to the number of family members.
