<br />Planning Commission <br />Meeting Minutes <br />OCTOBER 9, 2008 <br />Page 8 of 11 <br />1) The Subdivider to fully comply with a public use dedication as set forth in <br />Section 16.16.060 of the Louisville Municipal Code. <br />2) The PUD shall be modified to reduce the number of proposed dwelling <br />units from a total of 12 units to 11 units on Lot 4. <br />3) The subdivision plat shall be revised to reflect the alley right-of-way <br />dedication by outlot. The conveyance of the right-of-way shall establish a <br />minimum alley width of 20' for the full length of the property backing up to <br />the alley. <br />4) In accordance with the provisions of the Floodplain Development Permit, <br />the lowest habitable floor elevation shall be certified at an elevation of <br />5,332. Elevation certificates shall be submitted for each dwelling unit prior <br />to the issuance of a certificate of occupancy. <br />5) The applicant shall coordinate with the City Forester to establish a <br />minimum setback around the existing Silver Maple Tree and incorporate <br />that requirement on the final PUD landscape plan. <br /> <br />Commission Questions: <br />Lipton inquired about the reduction of one unit and why it does not meet the <br />underlying zoning requirement. <br /> <br />Wood stated the concern was for the layout and function of the site <br /> <br />Lipton discussed that with other proposals when an applicant has requested <br />additional density then the applicant has provided other dedications above and <br />beyond what has been required. <br /> <br />Wood agreed that other developments have provided additional Public Land Use <br />dedications for the extra density. When staff looks at the compliance of the PUD <br />and zoning requirements then the density in itself is not a "no go" for a <br />recommendation by staff. <br /> <br />Lipton asked what other developments in town provide alley access as the <br />primary access to the residence. <br /> <br />Wood stated the Old Town Overlay District requires the use of the alley for <br />access to a garage but not as the primary access to the residence. <br /> <br />Lipton briefly discussed the alley access for the Pine Street Park subdivision on <br />the north/south alley is public access and the east/west alley is private access. <br /> <br />Paul stated the alley does create some concerns for emergency access, and the <br />limit of accessibility to the public for in and out of the site. <br /> <br />Lipton asked if the City has any concerns with the maintenance of the alley that <br />provides major access to the site. Also, will the alley be built to City standards - <br />width, asphalt, etc? <br /> <br />Wood stated that would need to be addressed by the Public Works department. <br /> <br />Applicant Presentation: <br />Garret Mundelein, 555 County Road, Louisville, CO. discussed a conversation he <br />had had with Craig Duffin regarding the construction standards for an alley and <br />
