SUBJECT: LEVEL CLEAR COVID-19 AND SPECIAL EVENTS UPDATE <br />DATE: MAY 11, 2021 PAGE 2 OF 8 <br />numbers for hospitalizations and positivity rates exceed the acceptable level. During this <br />time all Boulder County residents, businesses, offices, events and others are required to <br />operate within the Level Blue Public Health Order (attached). Beginning on May 16, <br />2021, Boulder County will move to Level Clear, and all residents, businesses, offices, <br />events and others will be required to follow the guidance outlined in the Level Clear <br />Public Health Order (attached). Level Clear is considered an observation period, during <br />which time the County could "snap -back", or return to a more restrictive level, at any <br />time based on hospitalization metrics. Level Clear is expected to be in place for 90 <br />days, until August 15, 2021. <br />Mask Requirements: <br />During this time of transition, both Boulder County and the City of Louisville have <br />continued to have a facial covering order in place. The City's mask Ordinance, which is <br />more protective and therefore supersedes the County's order within City limits, requires <br />face coverings to be worn within all indoor public spaces. Under the City's Ordinance <br />and the County's Order facial coverings are not required outdoors. Exceptions to the <br />indoor masking requirement, including for children under 2, can be found in the City <br />Ordinance (Ordinance No.1805 Series 2021, attachment 2). <br />On May 5, 2021 BCPH adopted a new Public Health Order (PH Order 2021-05, <br />attachment 3). Masking is still required indoors in certain locations (regardless of <br />vaccination status), including the following: <br />• Preschool through grade 12 schools (including extracurricular activities), <br />childcare centers and services, and indoor children's camps, regardless of <br />whether a license is required for such activities. <br />• Public areas of state government facilities, county or municipal government <br />facilities, and areas of such government facilities where members of the public <br />come into contact with government employees. <br />• Congregate care facilities, including nursing facilities, assisted living residences, <br />intermediate care facilities, and group homes. <br />• Prisons and Jails <br />• Emergency medical and other healthcare settings, including hospitals, <br />ambulance service centers, urgent care centers, non -ambulatory surgical <br />structures, clinics, doctors' offices, and non -urgent care medical structures. <br />• Retail stores, grocery stores, and the public -facing portion of any other business. <br />However, the County Order now includes several exemptions based on vaccination <br />status for indoor areas other than those listed above, including: <br />• There are 9 or fewer unvaccinated individuals or individuals of unknown <br />vaccination status present in the space; or <br />• At least 80% of the individuals in the space have shown proof of vaccination. <br />CITY COUNCIL COMMUNICATION <br />3 <br />
