City Council <br />Meeting Minutes <br />July 27, 2021 <br />Page 8 of 13 <br />Kim Crawford noted this ordinance would be the official action to place this item on the <br />ballot in November and it sets forth the ballot title. <br />Public Comments — None. <br />MOTION: Councilmember Fahey moved to approve Ordinance No. 1810; Councilmember <br />Brown seconded. <br />Councilmember Lipton reiterated that, if approved, these funds can be used for items <br />other than underpasses and he urged the Council to keep other options in mind that might <br />be less expensive than underpasses and still be a great benefit to the community. <br />Public Comments — None. <br />Mayor Stolzmann closed the public hearing. <br />VOTE: Motion passed by unanimous roll call vote. <br />ORDINANCE NO. 1812, SERIES 2021 — AN ORDINANCE REINSTATING <br />PROVISIONS OF THE LOUISVILLE MUNICIPAL CODE REGARDING PENALTIES <br />FOR NON-PAYMENT OF WATER CHARGES — 2ND READING, PUBLIC HEARING <br />(advertised Daily Camera 7/18/21) <br />Mayor Stolzmann introduced the item and asked if there were any disclosures; hearing <br />none she opened the public hearing. <br />Deputy City Manager Davis stated that during the COVID-19 pandemic the City Council <br />adopted Emergency Ordinance No. 1792, Series 2020 which suspended water <br />disconnections and other penalties for non-payment to the City's utility customers. The <br />purpose of the ordinance was to provide relief to City water customers experiencing <br />financial impacts as a result of COVID-19. These relief measures will remain in place for <br />the duration of the City's declaration of a local disaster emergency, which is still in effect, <br />or until modified or repealed by subsequent ordinance of the City Council. <br />At the June 15 meeting, Council directed staff to bring back an ordinance reinstating the <br />City's ordinances related to penalties and disconnections for non-payment of utility bills. <br />In addition, Council requested the City continue to support the Utility Bill Assistance <br />Program and provide outreach to any delinquent customers regarding the reinstatement <br />of the City's standard non-payment penalty provisions. <br />If approved, Ordinance 1812, Series 2021 would reinstate the City's penalties for non- <br />payment of water bills. It would go into effect September 30, 2021 and the City would <br />begin applying standard collection procedures. It authorizes and encourages City staff to <br />enter into payment plans with water customers who have accumulated significant past- <br />
