City Council <br />Meeting Minutes <br />August 17, 2021 <br />Page 5 of 12 <br />At the last meeting Council asked for information on electrification codes and information <br />about in surrounding communities. Staff provided policy information and comparative <br />municipal information in the packet. He reviewed new State laws, noted Denver's new <br />NetZero plan, and some other examples. <br />Mayor Stolzmann asked if the open space parcels could be officially zoned as open <br />space at the time of dedication. Director Zuccaro stated that could happen concurrently. <br />Councilmember Brown asked what the acreage is north of Disk Drive. Director Zuccaro <br />stated it is roughly 160 acres. <br />Mayor Stolzmann stated she would like the ponds on the site preserved and would like to <br />require a land dedication with all the ponds and not have buildings encroaching on the <br />ponds. This would also enlarge the buffer with Paradise Lane as required in the <br />Northwest Parkway IGA. <br />Mayor Pro Tern Maloney asked if the areas around the pond could be dedicated as open <br />space could the council allow higher buildings to the west in exchange. Director Zuccaro <br />stated the current proposal would have the applicant preserving sections of Parcels B & <br />C3 as private common open space with a deed restriction in return for taller buildings in <br />Parcel C3 and with a similar agreement for what would be developed in Parcel A. <br />Mayor Pro Tern Maloney asked what the building height change would be as proposed. <br />Director Zuccaro stated the building heights were not specified in the proposal but are <br />listed as from 3-5 stories. <br />Mayor Pro Tern Maloney asked how private common open space would be maintained. <br />Director Zuccaro stated the proposed amendment to the PCZD agreement outlines <br />maintenance standards and states the areas would be maintained in an natural state and <br />some limited improvements could be approved through a PUD process. <br />Councilmember Lipton asked if there were any options for moving buildings within the <br />parcels and keeping other areas as open space. Director Zuccaro stated that GDP lays <br />out the intented of the uses on the property but exact building heights and locations are <br />set at PUD. <br />Mayor Stolzmann asked if it is within the discretion of the Council to determine where the <br />open space should be on the property. Director Zuccaro stated that is within the <br />judgement of the Council but they are reviewing a specific proposal as part of the <br />application. <br />Mayor Stolzmann asked if there is a requirement that Council accept some areas as <br />private open space and some as City open space; can Council determine where open <br />space is required and try to reach an agreement with the applicant. <br />
