2. City's Responsibilities. The City will make available a City police command officer to <br />provide incident situational awareness, a safe route in, request for services, expected timeframe, <br />access to communications interoperability, and inclusion in the ICS structure. <br />3. Term. The City agrees to use the Contractor's Services in connection with responses requiring <br />crime scene search and security including aerial Drone, missing persons search, water evidence <br />search, and disaster management needed and required by it during the period from November <br />1, 2021 and October 31, 2022, inclusive, and the Contractor covenants and agrees to provide <br />said Services as required and requested by the City via the Boulder County Communications <br />Center during said period. Contractor acknowledges that this Contract does not grant any <br />exclusive privilege or right to supply services to the City. <br />4. Compensation. City agrees to pay Contractor $5,000 annually for said Services. Payment by <br />the City will be made within thirty (30) days following the receipt of an invoice from the <br />Contractor. <br />5. Limitations of BES Responses. This agreement will not be interpreted in such a way as to: <br />a. Limit BES's operations when requested by Boulder County Colorado, the Boulder <br />County Sheriff Office, or agencies other than the city for areas outside of the City. The <br />City recognizes that BES also assists other agencies with requests for the services <br />described in this Agreement. If BES is participating in other rescue efforts when it <br />receives a request for assistance from the City then BES has the authority to determine <br />what resources, it has available to respond to the request by the City. <br />b. Require BES to assign or lend its corporate -owned equipment to the City or other persons <br />or agencies. <br />6. Insurance. Contractor agrees to procure and maintain in force during the terms of this <br />Contract, at its own cost, the following minimum coverages: <br />A. Workers' Compensation and Employers' Liability <br />i. State of Colorado: Statutory <br />B. General Liability <br />i. General Aggregate Limit: $2,000,000 <br />ii. Per Occurrence: $1,000,000 <br />C. Aviation Insurance -Unmanned Aerial Systems <br />i. Per Occurrence $1,000,000 <br />Coverage provided should be at least as broad as found in Insurance Services Office <br />(ISO) form CG0001, to include all premises and operations. The policy shall include coverage <br />for bodily injury, broad form property damage (including completed operations), personal injury <br />
