<br />Motion to Invite Dr. Axelrod <br />to next Council Meeting <br /> <br />Mayor Meier <br /> <br />MEDEMA/WAREMBOURG LAW SUIT <br /> <br />Motion re: Constitutional <br />Rights of Citizens <br /> <br />9/6/83 <br /> <br />Page -8- <br /> <br />that blacks out their emergency room. Also <br />he argued that his costs would be signifi- <br />cantly less than the Community Emergency <br />Room - felt Dr. Axelrod should explain to <br />council how he intends to maintain those costs <br />at a lower level. <br /> <br />Councilman Leary moved, Councilman Cummings <br />seconded that Dr. Axelrod be invited to the <br />next council meeting to address these 4 points. <br />Question called for. All in favor. Motion <br />carried unanimously. <br /> <br />Inquired of Councilman Leary who could be con- <br />tacted for copies of the hearing so that <br />Council could review both sides of the issue. <br />The reply was - State Health Dept. Mayor <br />Meier instructed Director Rupp to obtain this <br />transcript. <br />Leary <br />Councilman/remarked the thing that bothered him <br />most about the lawsuit was that the petitioners <br />were also being sued on a referendum issue. <br />This is a Constitutional Right people have and <br />felt this was total harrassment. <br /> <br />Councilman Leary moved, Councilwoman Morris <br />seconded that the City Council of Louisville <br />finds the court filing by Medema Homes and <br />Mr. Warembourg, the plantiffs against the <br />representatives of the referendum petition <br />on Ordinance #791 to be a miuse and abuse <br />of the American judicial system and an affront <br />to the constitutional rights of the citizens <br />of Louisville. The rights of referendum and <br />initiative are solely reserved for the citizens <br />of this City, State and County and any effort <br />to interfere with this right cannot be un- <br />challenged by a body sworn to uphold the <br />Constitution of the State of Colorado. There- <br />fore, since the action by the plantiffs is a <br />blatant attempt to undercut the constitu- <br />tional rights of the citizens of Louisville, <br />let it hereby be known that the City Council <br />of Louisville abhors this action and calls <br />upon said plaintiffs to withdraw their suit <br />against the representatives of the referendum <br />peition on Ordinance #791. <br />
