2/15/83 Page -12- Director of Community Development John Rupp Gave a slide presentation of the proposal, stating the development was located in the southwestern portion of the City; zoned residential - medium; consisting of 13.6 acres; proposal was for 23 six-unit condo- minium buildings; a homeowners association will be responsible for maintaining open space; buildings will be 25 feet in height. Developer is constructing a recreation center and pool for use of residents; major access to be off Cherry St. Emergency access pro- posed through Juniper Court. Proposed density is 12 units per acre, which is within the parameter of our zoning regulations. Staff and the Planning Commission recommended ap- proval. Referred to the Subdivision Agreement section 1.3, wished assurance from Director Rupp regarding the statement "the Subdivider shall make all needed repairs or replacements due to defective materials or workmanship within 10 days of written notice by the City," the City would make such repairs and bill the developer, that this would be enforced. Rupp advised that it would - requirement written into all subdivision agreements. Cummings felt there should be a reimbusement timetable if the City is required to make the repairs. Knew of other occasions where the City had made such repairs and had diffi- culty being reimbursed. Attorney Rautenstraus stated he felt this was a valid suggestion. Advised, however, he felt this could be better dealt with before the development is complete by withholding building permits, Certificates of Occupancy, or calling on the letter of Credit. However, if Council desired a time- table on repairs be added to the Agreement he would comply. Discussion by Mayor and councilmembers followed all agreed a timetable should be added to all subdivision agreements on repairs. Councilman Cummings Timetable on Repairs Street Lights in the Sub- division Councilman Cummings inquired if there was a timetable set on the street lights within a new subdivision. Director Rupp and Ad- ministrator Wurl advised Public Service made this decision.
