<br />2/15/83 <br /> <br />Page -12- <br /> <br />Director of Community <br />Development John Rupp <br /> <br />Gave a slide presentation of the proposal, <br />stating the development was located in the <br />southwestern portion of the City; zoned <br />residential - medium; consisting of 13.6 <br />acres; proposal was for 23 six-unit condo- <br />minium buildings; a homeowners association <br />will be responsible for maintaining open <br />space; buildings will be 25 feet in height. <br />Developer is constructing a recreation center <br />and pool for use of residents; major access <br />to be off Cherry St. Emergency access pro- <br />posed through Juniper Court. Proposed density <br />is 12 units per acre, which is within the <br />parameter of our zoning regulations. Staff <br />and the Planning Commission recommended ap- <br />proval. <br /> <br />Referred to the Subdivision Agreement <br />section 1.3, wished assurance from Director <br />Rupp regarding the statement "the Subdivider <br />shall make all needed repairs or replacements <br />due to defective materials or workmanship <br />within 10 days of written notice by the City," <br />the City would make such repairs and bill <br />the developer, that this would be enforced. <br />Rupp advised that it would - requirement <br />written into all subdivision agreements. <br />Cummings felt there should be a reimbusement <br />timetable if the City is required to make <br />the repairs. Knew of other occasions where <br />the City had made such repairs and had diffi- <br />culty being reimbursed. <br />Attorney Rautenstraus stated he felt this <br />was a valid suggestion. Advised, however, <br />he felt this could be better dealt with <br />before the development is complete by <br />withholding building permits, Certificates <br />of Occupancy, or calling on the letter of <br />Credit. However, if Council desired a time- <br />table on repairs be added to the Agreement <br />he would comply. Discussion by Mayor and <br />councilmembers followed all agreed a timetable <br />should be added to all subdivision agreements <br />on repairs. <br /> <br />Councilman Cummings <br />Timetable on Repairs <br /> <br />Street Lights in the Sub- <br />division <br /> <br />Councilman Cummings inquired if there was <br />a timetable set on the street lights within <br />a new subdivision. Director Rupp and Ad- <br />ministrator Wurl advised Public Service made <br />this decision. <br />
